DescriPtion) Finance: Council No~s: 75.0262 Agenda Item No /? , CIT9 OF SAN BERNARDIQ - REQUEa- FOR COUNCIL AC1:bN STAFF REPORT On May 23, 1988, the Mayor and Common Council adopted the Interim Policy Document (IPD) and the Preferred Land Use Alternative to govern development actions pending the adoption of a final General Plan. The IPD was revised by the Mayor and Council on June 6, 1988. . , The IPD, by its terms, supercedes the City's zoning with a result that with a few minor exceptions no zoning standards are applicable to development within the City. Certainly, such a result was not the intent of the Mayor and Common Council. The proposed resolution would do the following: 1. Incorporate the current development standards for the zoning ordinance (Title 19 of the Municipal Code) into the IPD. insofar as such standards are consistent with the provisions of the IPD. 2. Clearly provide that zone changes are not required. 3. Provide that lesser density developments may be built in any residential land use designation with the exception that single-family developments may not be built in mUlti-family designations. 75.0264 . o 1 2 3 4 5 6 7 8 o o o RESOLUTION NO. RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING THE INTERIM POLICY DOCUMENT RELATING TO DEVELOPMENT STANDARDS PENDING ADOPTION OF A FINAL GENERAL PLAN. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Section 44 of the Interim POlicy Document is hereby amended to read as follows: "44. Zone changes need not be made, and development 9 consistent with this document despite the requirements of the 10 underlying zone district may be processed, during the life of the 11 Interim POlicy Document." 12 13 14 15 16 17 18 19 20 21 22 23 24 SECTION 2. Section 47 of the Interim POlicy Document is hereby amended to read as follows: "47. All of the standards of the existing zone districts as specified in Title 19 of the San Bernardino Municipal Code which are deemed compatible by Attachment C with the land use designations adopted by this document and the Preferred Land Use Alternative are hereby incorporated into this document and shall apply to development within the specific land use designation unless otherwise specified in this Interim POlicy Document. In any conflict between the requirements of this document and Title 19, the provisions of this document shall take precedence. If the underlying existing zone district is compatible with the Interim POlicy Document and the Preferred Land Use Alternative as 25 shown on Attachment C, then the underlying zone district 26 standards shall apply. Determination of which zone district is most restrictive shall be made by reference to Attachment C." SECTION 3. Section 71 is hereby added to the Interim Policy Document to read as follows: "71. Any residential land use designation outlined in the Preferred Land Use Alternative shall also allow development consistent with this document less dense than the density standard specified for such land use designation; provided, however, that mUlti-family designations shall not allow detached single-family dwelling units unless otherwise specifically allowed herein." SECTION 4. Attachment C is hereby amended as shown on Attachment C attached hereto and incorporated herein.
