That the Mayor and Council accept the offer of $105,000.00 as a fair
share contribution to storm drain problems from developers of Tract
12313, and further direct staff to combine these funds with normal
storm drainage development fees to be used to address drainage con-
cerns in this area of the communi ty.

STAFF REPORT
The developers of Tract 12313 have submitted the attached letter
requesting the City consider accepting a dollar contribution of
$105,000.00 as a fair share contribution to the drainage problems that
exist in the area.
Presently, the City of San Bernardino, Colton, and the County of San
Bernardi no are parti ci pa ti ng in a study of the area and a ttempti ng to
reach some resolution of the growing drainage problems. Very
preliminary estimates by the County place the dollar cost for improve-
ments required at $6,667 per acre. Final results and accurate costs
will not be available until sometime after the first of the year. The
proposed development is approxi ma tely 57.8 acr,es of si ngle-fami 1 y
development, and is subject to normal City drainage fees amounting to
$2,178 per acre. The contribution of $105,000 is in addition to the
normal fees and amounts to $1,816 per acre. Combining the two yields
$3,994 per acre, conditions on the development by the Planning
Commission require that the developer address the drainage issues. The
development in and of itself is safe from storm water damage. All flows
will be contained in the street sections or drainage structures and pose
no threat to property until much farther downstream and generally
outside of City jurisdiction.
The developer is anxious to proceed with the development, and the
results of the flood control study may not yield viable solutions even
when the study is completed. Considering the development is itself safe
and the streets surrounding it are not sUbject to flooding, the
developers proposed contribution seems fair to all concerned. To date,
there is no mechanism in place to require developers in this area to
participate in costs for the associated downstream requirements, yet
this developer is offering a fair share contribution prior to
development in order to address the concerns of the City.
Staff would therefore recommend that the Mayor and Council approve and
accept the $105,000.00 as a fair share contribution from Tract No. 12313
and allow the development to proceed. Additionally, that the funds be
directed into a trust account along with normal drainage fees to be used
for the downstream improvements as suggested by the study currently
underway at the County.

2. Landscapi nq:
A) A Landscape Maintenance District shall be established prior to recor-
dation of the final map (first map if phasing is proposed). The
district shall include all landscaping within the public right-of-way
along the following streets: Mill Street, Pepper Avenue. Euclayptus

D) Drainage devices shall be designed as necessary to control flows
identified by the hydrology study. Surface flows shall not exceed
Q100 wi thi n the street right-of-way and Q25 at top of curb. All
sumps shall be desi gned wi th a secondary overflow.
E) A storm drain shall be designed and constructed to.convey flows fro.
the southwest corner of Mill street and Pepper Avenue across Pepper'
Avenue to the existing line on the east side of Pepper Avenue.
F) Drainage easements shall be dedicated to the City of San Bernardino
as necessary.
