At the meeting of the Mayor and Common Council of October 6, 1986, a question
arose relative to who would be paying assessments and what the boundaries of
the district would be.
In regards to the boundaries, the proposed district lies wholly within the
boundaries of Wards 4, 5 and 6. The backup memo erroneously indicated that
Ward 7 was involved, however, that is not the case.
Relative to who pays the assessments, all property owners within the boundaries
could be assessed and, therefore, would have a voice at the protest hearing.
Meetings have been held with Councilman Quiel in this regard and it was de-
cided to eliminate those areas which are presently developed and everything
south of the 1-215 Freeway (Ward 6).
By doing so, the boundaries of the proposal would then be wholly within Ward 5.
If those properties owned by the City and State and certain undevelopable
lands on top of Shandin Hills were eliminated, there would be little remaining.
(See attached map) There is presently a proposed landscape maintenance
district in the area of Pine and Belmont (A.D. 976) which can be expanded to
include new areas.
Presently, any new subdivision located Westerly of Pine Avenue requiring the
maintenance of landscaping, will be required as a condition of development,
to create a new district to maintain the landscaping. Some of these particu-
lar areas are zoned for 1 acre parcels, and many are already improved in that
fashion, with no landscaping to be maintained by the City. For these reasons,
it would appear to be easier and more cost effective to deal with new develop-
ments on an individual basis.
Therefore, it is the recommendation of this Department that the proceedings
for proposed Assessment istrict No. 972 be terminated.

Recommended motion:
MOTION NO.1:
That in regard to proposed Assessment District No. 972, that any land
belonging to the City of San Bernardino which lies within the bound-
aries of the district be arbitrarily subdivided into 7200 square-foot
units for purposes of assessment and that the City will annually
contribute to the district the calculated annual assessments placed
upon those arbitrary units.

STAFF REPORT
On February 17, 1986, your Honorabl e Body authori zed thi s offi ce to
proceed with the establishment of a landscape maintenance district in the
Northwest San Bernardino area as delineated on the attached plat map.
The assessments on this district will be spread on the basis of one unit,
one asessment and large vacant areas will be arbitrarily subdivided into
7200 square-foot lots minus 251 for future streets.
There are a few school properties in the district plus the State College
and City-owned properties. We will be asking the School District to pay
their fair share based on the formula, and we will ask the State College
to pay their share based as though their Northpark Boulevard frontage
were 70 foot-wide lots. However, before we can ask any of them to
participate, we feel that it would be prudent to have the City's
properties also assessed their fair share according to formula. This
would affect all City-owned property including Water Department property
and all Park property lying within the boundaries of the ditrict. By
formula, there will be 547 assessable units at a variable rate predicated
upon whi~hever zone the land is involved with. Time is the factor whic~
will determine the dollar amount of the assessments per zone as presently
most of the 13 zones will have little or no assessments until the demand
is there and/or the landscaping is installed.
If you choose to do the above, adopt Motion No. 1. If you wish to
eliminate the City, School District and State from the assessments, adopt
Motion No.2.
