STAFF REPORT
The De~artment of .public Services has requested the County of San Bernardino
Sheriff's Department to provide inmates for participation in a weekend-work
program to provide necessary cleanup prior to the start of the rainy season.
Work to be performed by the inmates will consist of litter pick-up, weed re-
moval and other aesthetic improvements to public rights-of-way. Priority in
work areas will be placed on major arteries with.high public visibility and
main entrances to the City. The Department of Public Services will admin-
ister the program in conjunction with the goals established by the More
Attractive Community Team.
Costs to the City will be relatively low. A copy of a report filed by the
field supervisor is attached with complete breakdo~n. A minimal amount of
equipment and safety gear will be used to fulfill the contractual agreement.

Although attempts were made by the City Attorney's Office to negotiate terms
into the contract, the County of San Bernardino refused to incorporate the
mutual hold harmless and indemnification clauses in the contract. This con-
tract is widely used between the County and State and other cities within
our County.
The program will be monitored closely and evaluated i~ four (4) or six (6)
months for cost effectiveness, productivity and other related measures before
making recommendations for continuance or discontinuance.

This is the program we will use on weekends with the workers
from Glenn Helen Correctional Instiution.
1. Workers will repGrt to the Public Services maintenance
yards at 234 So. Mt.View at 6:45 A.M. and no later then
7:00 A.M. to building 104 to sign in for the day and re-
ceive there work assignments.
2. Workers will be transported from there to predetermined
work location by van and trucks by no later then 7:15
A.M. At the end of the work d~y they will be transported
in the same manner )',ack to the maintenance yards at 2 :45
P.M. and no later then 3:00 P.M. to sign out for the day
3. Workers will be allowed two (2) fifteen minute (15) rest
breaks and one(l} thirty (30) minute lunch break. h~l

the job site at all time with supervision.

6. Workers will be issued work gloves and safety vest at the
start of each work day and they will be returned at the
end of the day. All work tool will be issued at the jOb
site and collected at the end of the day before workers
are transported back to the maintenance yards

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH THE COUNTY OF SAN BERNARDINO
3 RELATING TO THE CITY'S PARTICIPATION IN THE SHERIFF'S WORK
SENTENCE PROGRAM.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
5 SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. The Mayor of the City of San Bernardino is hereby
7 authorized and directed to execute on behalf of said City an
8 Agreement with the County of San Bernardino relating to the City's
9 participation in the Sheriff's Work Sentence Program, a copy of
10 which is attached hereto, marked Exhibit wAw and incorporated
11 herein by reference as fully as though set forth at length.
12 I HEREBY CERTIFY that the foregoing resolution was duly
13 adopted by the Mayor and Common Council of the City of San
14 Bernardino at a meeting thereof, held on

WITNESSETH:
WHEREAS, the County of San Bernardino Sheriff's Department
conducts and administers a work program under Penal Code, Section
4024.2 for the performing of work by persons committed to the custody
of the Sheriff; and
WHEREAS, The ci ty of San Bernardino Public Services Department
desires that participants in such work programs be placed with it
for work under the direction and control of the City.
NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS:
(1) County Of San Bernardino Sheriff's Department may
place inmates performing work under the aforesaid program with
the City. The number of participants shall depend upon the
work available and the ability to administer and control the
work program.
(2) On placement of persons under this agreement by the
County of San Bernardino Sheriff's Department with the City,
the work of the participants will be under the direct super-
vision and control of the City.

(3) The work to be performed by program participants will
consist of litter pickup, weed removal, and other asthetic
improvement to public lands, property and roadways.
(4) The City will not provide any security guards and the
City employee(s) working with participants will not physically
restrain any participants that might leave the work area. The
County of San Bernardino Sheriff's Department will be notified
by the end of the day of any participants who leave the work
area w~thout permission.
(5) The City will provide transportation for participants
working under this agreement to and from the work sites as
needed from pickup' points agreed td between the County of San
Bernardino Sheriff's Department and the City.
(6) Equipment operations will be performed only by
qualified City employees.
(7) The City will provide program work participants with
safety equipment such as signs, hard harts and red vests.
(8) The City will provide safety instructions, explain
the work to be done and direct the work of the work pro-
gram participants placed under this agreement.
(9) In the event that a claim for industrial injury is
filed by a participant working under this agreement under
the direction of the City, the County of San Bernardino will
be responsible for the administration of the claim in the
manner as if the work participant was a County of San
Bernardino employee. The City will reimburse the County
of San Bernardino for all costs incurred in the administration
of such claims including any settlement costs or awards to
participants. Any settlement costs or awards shall be subject
to the City's prior approval.

(10) The City shall indemnify, hold harmless and defend
County of San Bernardino, its agents and employees from any
and all actions, claims or suits of every name, kind and
description, which may be asserted by any person, including
any work participant placed by County of San Bernardino with
the City arising out of or in connection with the performance
of work for the City by any participant during the period of
placement with the City.
(11) This agreement shall become effective upon its execu-
tion by all of the parties hereto. The agreement may be
terminated by either party upon thirty (30) days written
notice to the other party.
IN WITNESS WHEREOF the parties hereto have caused this
agreement to be executed by their duly authorized officers.
