Source: Finance: Council Notes: Aoenda It"m Nn / Cj, 75-0262 . o ~. o o o 1 RESOLUTION NO. 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ADOPTING FINDINGS RELATING TO CONDITIONAL USE 3 PERMIT NOS. 86-28 AND 86-33 AND DENYING SUCH PERMITS. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 5 6 SECTION l. Recitals. 7 A. At the Council meeting of October 20, 1986, the Mayor and Common Council received information pursuant to San 8 9 10 11 12 13 Bernardino Municipal Code se~tion 19.68.0l0 to permit the moving of two existing single-family structures presently located at 26470 Millar Street and 26432 Rainbow Lane in Highland to 2130 and 2138 West Lincoln street in the R-l-7200, Single-Family Residential District. I B. A recent amendment to San Bernardino Municipal Code 14 Chapter 19.68 requires that a conditional use permit be 15 16 17 18 19 20 21 22 23 24 25 26 27 28 obtained prior to moving any building within the City. C. The primary purpose of the aforementioned amendment requiring that a conditional use permit be obtained prior to moving a building was to ensure that one area of the community not be inundated with an exorbitant number of requests for building move-ons. SECTION 2. Findinas. The Mayor and Common Council a~opt the following findings relating to the denial of Conditiohal Use Permit Nos. 86-28 and 86-33: A. All house moving activity in the city has occurred in the First, Third and Six Wards. B. Such move-ons have, in the past, been of poor quality construction. -1- o ~ u o o 1 2 3 4 5 6 C. Move-ons have a blighting influence on the West Side in general and on the sixth Ward in particular. D. The City wishes to encourage rehabilitation and upgrading of the West Side by encou~aging new construction. E. There are existing move-ons in the Sixth Ward which were never completed. i 8 F. The proposed residential uses conform with the goals and objectives established within the General Plan and the 9 Uptown Redevelopment Plan of the City of San Bernardino. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 G. The area in question, over the past two years, has been subject to numerous requests for building move-ons and currently over l2 units are, in one st~ge or another, in the development process. H. The subject properties are'two rectangularly-shaped parcels of land consisting of appr~xi~ately .57 acres, each located at 2130 and 2138 West Lincoln Street. I. The proposed uses could adversely impact the community uses, and the growth and development of the area in which it is proposed. J. The size and shape of the respective sites are adequate to accommodate the proposed uses in a manner not , detrimental to the area, nor to the peace, health, safety or general welfare of the citizens of the City of San Bernardino. K. Traffic generated by the prbposed use will not impose , any undue burden upon the streets and highways in the area. Adequate off-street parking is propos,d on each site. L. The granting of Conditional Use Permit Nos. 86-28 and 86-33 will be detrimental to the peace, health, safety or -2- o o o o 1 2 3 4 5 6 general welfare of the citizens of the City of San Bernardino. M. The proposed use is not compatible with the surrounding uses within the immediate area and could have an adverse affect upon adjacent properties. SECTION 3. Denial of Dermits. 7 Based upon the foregoing findings, the findings of the Planning Department, and the findings made at this hearing, 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 the Conditional Use Permit Nos. 86-28 and 86-33 are denied.
