OF SAN BERNARDpOO - REQUI(5T FOR COUNCIL ACOON STAFF REPORT Page 2 of 2 It is our understanding that the agreement for settlement of litigation provides an amount of $l50,000 to finance these improvements. The reimburse- ment agreements with Hill Williams provide for them to reimburse the City for the costs that they would have incurred, due to development of their properties on the north and south sides of Piedmont Drive. Under this arrangement, the City will have to up front all of the costs for Schedule One, and be reimbursed at the time the parcels are developed. Hill Williams is presently in escrow for the parcels along Piedmont Drive. Mr. Rick Lazar, Realtor, has advised us that escrow is scheduled to be closed on 10-29-86 or lO-30-86. Easement forms, for dedication of the necessary right-of-way for the extension of Piedmont Drive, are being prepared in our office. These forms will be presented to Hill Williams for execution immediately upon close of escrow. It will be necessary for the easement to be granted before a contract can be awarded. The original estimate for extending Piedmont Drive did not include any storm drainage improvements. During development of the plans it became apparent that a drainage problem could be created. Therefore, construction of catch basins on Piedmont Drive, and installation of a master plan storm drain, were included. The bid price for items 8 - l2 is $79,088. Hill Williams will reimburse the City for their cost to install these facilities, upon development of the parcel to the north of Piedmont Drive. Several contractors were called to our office to make sure they were aware of this project. The general response was that they were too busy to submit a bid. A more favorable bid could be expected if the project were re-bid in a few months. URGENCY CLAUSE: A public meeting is scheduled at 5:00 p.m. at the Council Meeting of ll-03-86. RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO BONADIMAN-McCAIN, INC. FOR CONSTRUCTION OF A CUL-DE-SAC ON PIEDMONT DRIVE. AT VICTORIA AVENUE, AND EXTENSION OF PIEDMONT DRIVE. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Bonadiman-McCain, Inc. is the lowest responsible bidder for constructioD of a cul-de-sac on Piedmont Drive, at Victoria Avenue, and Extension of Piedmont Drive, in accordance with Plan No. 7063, for the total amount of $ , a contract for Schedules One and Two, and Additive Alternates is awarded to said bidder accordingly, but such award shall be effective only upon the contract being fully executed by the parties; and the Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. SECTION 2. Execution and Amendments. This contract and any amendments or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act Dr course of conduct of any party.
