The Negative Declaration for environmental review was also recommended for approval. Recommended motion: To approve the responses to comments and to adopt the Negative Declara- tion for environmental impact which has been reviewed and considered. AGENDA ITEM HEARING DATE PAGE 1, The applicant requests approval to move two (2) single- family detached structures from 26432 Rainbow Lane and 26470 Millar street in Highlanu to 2130 and 2138 West Lincoln Street respectively. 2. The subject properties were created under Parcel Map No. 8608, originally approved by the Planning Commission on July 17, 1984. Subsequently a one-year extension of time from June 19, 1986 to June 19, 1987 was granted at the July 8, 1986 Planning Commission meeting. The aforementioned Parcel Map created two (2) lots consisting of approximately 0.57 acre with identical dimensions (75' x 330') and consisting of approximately 24,750 square feet each. 3. The site is currently vacant. Surrounding properties are predominantly developed as single-family residential. The surrounding residential development is in need of varying degrees of repair. The proposed move-on structures are generally larger than those in the immediate vicinity. The area was originally subdivided into identical 1.14 acre parcels. Over the years subdivision of these acre parcels has occurred so that at present a variety of lot sizes exist. The entire area is zoned R-1-7200, Single-Family Residential. The General Plan and the Northwest Redevelopment Plan both designate the subject properties and the surrounding areas as Low Density Single-Family Residential (0-3 du/ac). 4. The structure presently located at 26432 Rainbow Lane, Highland has a floor area of 1,825 square feet and contains three bedrooms, two baths, wing and family living rooms, kitchen and laundry room. A 22' x 32' (704 sq. ft.) attached garage is proposed for moving as well. 5. The structure located at 26470 Millar Street, Highland has a floor area of 1,215 square feet exclusive of 400 square foot attached garage. The residence contains three bedrooms, two baths, living room and kitchen with a porch area to the rear. 6. The submitted site plan positions the structures with a minimum 25 foot front setback for the 2130 West Lincoln Street location, and a 35 foot front setback for the 2138 West Lincoln Street location. A recent amendment to the City of San Bernardino Municipal Code Chapter 19.68 requires that a Conditional Use Permit be obtained prior to moving any building within the City. Conditions to use, set forth in the amended section, include a requirement that construction be completed within 120 days from the date of issuance of the Building Permit. A bonding requirement is also established in order to ensure project completion <Section 19.68.100). 8. The primary purpose of the aforementioned amendment requiring that a conditional use permit be obtained prior to building moving was to ensure that one area of the community not be inundated with an exorbitant number of requests for building move-ons in one section of the community. The area in question, over the past two years, has been subject to numerous requests for building move-ons and currently over 12 units are, in one stage or another, in the development process. Until such time as these units have been completed and occupied, the approval of any new move-ons may unduly burden the surrounding area. The proposed residential uses conform with the goals and objectives established within the General Plan and the Uptown Redevelopment Plan of the City of San Bernardino. 2. The proposed use could adversely impact the community uses, and the growth and development of the area in which it is proposed. 3. The size and shape of the respective sites are adequate to accommodate the proposed uses in a manner not detrimental to the area, nor to the peace, health, safety or general welfare of the citizens of the City of San Bernardino. 4. CUP No. 86-28 and CUP No. 86-33 shall be in effect for a period of~ months from the date of approval by the Planning Commission and/or Planning Department. However, if no development has been initiated at the end of the~-month time period the approval shall expire, Additional time may be approved by the Planning Commission upon request of the applicant prior to expira- tion of the12-month time period. Expiration Date: October 7, 1987. COVENANTS, CONDITIONS AND RESTRICTIONS FOR P.R.D. a. The Covenants, Conditions and Restrictions (CC&R's) shall be reviewed and approved by the Planning Department prior to final approval of the tract maps. The CC & R's shall include liability insurance and methods of maintaining the open space, recreation areas, parking areas, private roads, and exterior of allbui ldings. The CC&R's shall also include a statement that no radio frequency antenna shall be included within the complex except for central antenna systems. b. No lot or dwelling unit in the development shall be sold unless a cor- poration, association, property owner's group, or similar entity has been formed with the right to assess all properties individually owned or jointly owned which have any rights or interest in the use of the common areas and common facilities in the development, such assessment power to be sufficient to'meet the expenses of such entity, and with authority to control, and the duty to maintain, all of said mutually available features of the development. Such entity shall operate under recorded CC&R's which shall include compulsory membership of all owners of lots and/or dwelling units and flexibility of assessments to ,meet changing costs of maintenance, repairs, and services. Recorded CC&R's shall permit enforcement by the City of provisions required by the City as conditions to approval. The developer shall submit evi- dence of compliance with this requirement to, and receive approval of, the Commission prior to making any such sale. This conditiDn shall not apply to land dedicated to the City for public purposes. c. Every owner of a dwelling unit or lot shall own as an appurtenance to such dwelling unit or lot, either (I) an undivided interest in the com- mon areas and facilities, or (2) a share in the corporation, or voting membership in an association, owning the common areas and facilities. d.
