Gentlemen:
At the meeting of the Mayor and co~on council held on
October 6, 1986, the proposed vacation of 17th Street, east
of Conejo Drive, and the appeal on the Planning Commission's
decision of denial of Variance No. 85-24, to waive Section
19.12.060 to allow an encroachment into a setback area in the
R-3-l200 Multiple Family Residential D~strict, were continued.
This matter will be heard at the Council meeting of
October 20, 1986, in the Council Chambers of City Hall, 300
North "D" street, San Bernardino, California. This item will
be on the Planning portion of the Council agenda, scheduled
for 2:00 p.m.

Council:
On October 8,1986 we met with representatives from EI
Dorado Bank, the City Attorney's office and the Planning
Department. The result of this meeting was an agreement
by Robert Nichols to draft a letter indicating, in detail,
the terms and conditions of our accord. Our attorney con-
tacted Hr. Nichols the following day to discuss the items
which were to be included in the letter. It is our under-
standing they are as follows:
1. The Dripp's are

2. The Dripp's will be reimbursed for the sum of one-
thousand three-hundred and five dollars ($1305.00).
3. 17th Street will be restored to its previous con-
dition before construction was initiated.
4. A concrete barrier similar to the type used for
freeway separators shall be placed between the building in
question and 17th Street.
5. Signs will be posted along 17th Street declaring
wNo Parking..Vehicles Towed at Owner's Expense".
6. The Bank will place two (2) lights on the building
bordering 17th Street.
7. The Bank will provide the Coulombe's with a con-
crete driveway which will provide access to their property
from Cross Street.
8. The Bank will provide the

9. Before a certificate of occupancy can be granted by

Providing our attorney receives Mr. Nichols' letter with
ample time to review and respond, a final aqreement can be
reached prior to the Council meeting on Monday, October
20, 1986. We are optomistlc that an equitable solution to
everyone's problem has finally been achieved.
