CI1C OF SAN BERNARDIO - REQU&C7 FOR COUNCIL AC1:))N STAFF REPORT The City is exposed to the possibility of liability claims arising from the potential misconduct of employees with criminal convictions prior or subsequent to hiring by the City. Penal Code Section 13300 provides that a City is entitled to arrest conviction information provided that such access is specifically authorized by the City Council by resolution or ordinance that express- ly refers to specific criminal conduct. provisions should be made for the payment of the State required finger- print processing fee which is at this time $18.50 per applicant. The Police Department currently requires that the fee be paid by the employee. It is therefore my recommendation that the Mayor and Common Council adopt a resolution which requires that each and every prospective employee of the City be fingerprinted for the purpose of a criminal history conviction screening through the Department of Justice as well as the local records as maintained by the San Bernardino Police De- partment if that employee may have access to vital City records, deal directly with minors and/or otherwise have contact with the public in the performance of their duties as City employees. conviction infor- mation for all felonies, assaults, thefts, fraud, buying, selling or p~S$sion of stolen property, sexual misconduct and drug offenses to be furnished directly to the Department Head or officer responsible for fulfilling employment, certification, or licensing duties. RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING CITY PERSONNEL ACCESS TO CRIMINAL INFORMATION HISTORY NEEDED TO EVALUATE PROSPECTIVE EMPLOYEES' ELIGIBILITY FOR EMPLOYMENT, CERTIPICATION OR LICENSING DUTIES. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. A. Penal Code Sections 11105(b) (10) and 13300(b) (10) 8 "authorize cities, counties, and districts to access state and 9 local summary criminal history information for employment, 10 licensing, or certification purposes. 11 B. Penal Code Sections 11105(b) (10) and 13300(b) (10) 12 require that there be a requirement or exclusion from employment, 13 licensing, or certification based on specific criminal conduct on 14 the part of the subject of record. 15 C. Penal Code Sections 11105 (b) (10) a.nd 13300 (b) (10) 16 require the city council to specifically authorize access to 17 summary criminal history information for employment, licensing, 18 or certification purposes. 19 20 SECTION 2. Restrictions. A. The City shall not consider a person who has been 21 convicted of a felony or a misdemeanor involving moral turpitude 22 eligible for employment or licensing, except that such conviction 23 may be disregarded if it is determined that mitigating 24 circumstances exist, or that the conviction is not related to the 25 employment or license in quertion. 26 B. (11) The subject of the state summary criminal history information under procedures established under Article 5 (commencing with Section 11120), Chapter 1, Title 1 of Part 4 of the Penal Code. (c) The Attorney General may furnish state summary criminal history information upon a showing of a compelling need to any of the following, provided that when infonnation is furnished to assist an agency, officer, or official of state or local government, a public utility, or any entity, in fulftlling employment, certification, or licenaing duties, the provisiona of Chapter 1321 of the Statutes of 1974 and of Section 432.7 of the Labor Code shall apply: (1) Any publie ublity as defined in Section 216 of the Public Utilities Code which operates a nuclear . energy facility when...... is needed in order to assist in employing persons to work at such facility, provided that, if the Attorney General supplies such data, he shall furnish a copy of such data to the person to whom the data relates. Furnishing to authorized persons; fingerprints on me without criminal history; fees (a) As used in this section: (1) "Local summary criminal history information" means the master record of information compiled by any local criminal justice agency pursuant to Chapter 2 (commencing with Section 13100) of Title 3 of Part 4 of the Penal Code pertaining to the identification and criminal history of any person, such as name, date of birth, phys- ical description, dates of arrests, arresting agencies and booking num- bers, charges, dispositions, and similar data about such person. (2) "Local summary criminal history information" does not re- fer to records and data complied by criminal justice agencies other than that local agency, nor does it refer to records of complaints to or investigations conducted by, or records of intelligence information or security procedures of, the local agency. (3) "Local agency" means a local criminal justice agency. (b) A local agency shall furnish local summary criminal history information to any of the following, when needed in the course of their duties, provided that when information is furnished to assist an agency, officer, or official of state or locai government, a public utili- ty, or any entity, in fulfilling employment, certification, or licensing duties, the provisions of Chapter 1321 of the Statutes of 1974 and of Section 432.7 of the Labor Code shall "lpply: (1) The courts of the state. 393 . (5) To any person when disclosure is requested by a probation, parole, or peace officer with the consent of the subject of the local summary criminal history Information and for purposes of furthering the rehabilitation of the subject. (6) The courts of the United States, other states or territories or possessions of the United States. (7) Peace officers of the United States, other states, or territo- ries or possessions of the United States. (8) To any individual who is the subject of the record requested when needed In conjunction with an application to enter the United States or any foreign nation. (9) Any public utility as defined in Section 216 of the Public Utilities Code, when access is needed in order to assist In employing persons who will be seeking entrance .to private residences In the course of their employment. The information provided shall be limit- ed to the record of convictions and any aITeSt for which the person is released on bail or on his or her own recognizance pending trial. " " d. . 1 o 0 o ~ ~ 13300 CRIMINAL STATISTICS Part 4 Any information obtained from the local summary criminal his- tory is confidential and the receiving public utility shall not disclose its contents, other than for the purpose for which it was acquired. Th~ local sununary criminal history information in the possession of the public utility and all copies made from it shall be destroyed 30 days after employment is denied or granted, including any appeal periods, except for those cases where an employee or applicant is out on bail or on his or her own recognizance pending trial, in which case the state sununary criminal history information and all copies shall be destroyed 30 days after the case is resolved, including any appeal periods. A violation of any of the provisions of this paragraph is a mis- demeanor, and shall give the employee or applicant who is injured by the violation a cause of action against the public utility to recover damages proximately caused by the violation. Nothing In this section shall be construed as imposing any duty upon public utilities to request local summary criminal history infor- mation on any current or prospective employee. Seeking entrance to private residences in the course of employ- ment shall be deemed a "compelling need" as required to be shown In this subdivision. (d) Whenever an authorized request for local summary criminal history information pertains to a person whose fingerprints are on file with the local agency and the local agency has no criminal histo- ry of that person, and the information is to be used for employment, licensing, or certification purposes, the fingerprint card accompany- Ing such request for Information, if any, may be stamped "no crimi- nal record" and returned to the person or entity making the request. (e) Whenever local summary criminal history Information ,fur- nished pursuant to this section is to be used for employment, licens- ing, or certification purposes, the local agency shall charge the person or entity making the request a fee which it determines to be suffi- cient to reimburse the local agency for the cost of furnishing such in- . formation, provided that no fee shall be charged to any public law en- forcement agency for local summary criminal history information furnished to assist it in employing, licensing, or certifying a person who is applying for employment with the agency as a peace officer, or criminal investigator.
