STAFF REPORT
The County of San Bernardino has requested that we participate in the cost of
resurfacing Pumalo Street from Golden to Del Rosa Avenue. Approximately 40%
of this section is within the corporate limits of the City of San Bernardino.
City portions are on Pumalo between Golden and Del Rosa Avenue.
The proposed agreement provided, in general, that the City will act as lead
agency and the resurfacing will be performed by City forces. The County will
reimburse the City for its proportionate share, estimated at $19,186.
Pumalo Street from Golden to Del Rosa Avenue is rated as top priority for re-
habilitation. We recommend the agreement be approved.
JUSTIFICATION FOR PLACEMENT ON SUPPLEMENTAL AGENDA:
This item was originally sent to the Mayor and Council August 27, 1986, for
their review, but was delayed by the Attorney's Office who sent the coopera-
tive agreement back to the County because of a disagreement in wording. We
are in the final stages of the current paving schedule and do not expect to
start again until March, 1987. This street was included in the Purchase Or-
der for the scarification now underway.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
5 SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. The Mayor of the City of San Bernardino is hereby
7 authorized and directed to execute on behalf of said City an
8 Agreement with the County of San Bernardino relating to the
9 resurfacing of pumalo Avenue from Golden Avenue to Del Rosa
10 Avenue, a copy of which is attached hereto, marked Exhibit -A- and
11 incorporated herein by reference as fully as though set forth at
12 leng th.

WHEREAS, COUNTY and CITY desire to cooperate and jointly participate in
a project for the heater scarifing and resurfacing of Pumulo Avenue from
Golden Avenue to Del Rosa Avenue hereinafter referred to as PROJECT; and
WHEREAS, PROJECT is partially in the unincorporated area of the COUNTY
and partially wi thin the incorporated area of the CITY, and will be of
mutual benefit to the COUNTY and CITY; and
WHEREAS, COUNTY and CITY desire to set forth the responsibilities and
obligations of each agency in relation to the performance of the proposed
resurfacing.
NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
CITY SHALL:
1.
Act as the Lead Agency in the design and construction of the PROJECT.
2.
Bear responsibility for the cost of the portions of the PROJECT
lying with the incorporated area of CITY. Said cost is currently
estimated to be $12,788.
3.
Provide specifications and estimates to County and obtain a no
cost permit from County prior to construction.

II. Upon completion of PROJECT, provide a cost analysis showing a
breakdoxn of the PROJECT costs in the incorporated area of the
CITY and in the unincorporated area of the COUNTY.
COUNTY SHALL:
1. Bear responsibility for the cost of the portions of the PROJECT
within the unincorporated area of the COUNTY. Said cost is currently
estimated to be $19.200 and shall not exceed $21,000 unless approved
by the COUNTY in writing.
2. Pay the COUNTY'S share of the costs within 30 days after submittal
of the cost analysis and billing by the CITY.
IT IS MUTUALLY AGREED AS FOLLOWS:
1. Neither party to this Agreement nor officers nor employees thereof
shall be responsible for any damage or liability occurring by
reason of anything done or emitted to be done by the other party
to the Agreement under or in connection with any work. authority
or jurisdiction not delegated to the parties under this Agreement.
It is also agreed that, pursuant to Government Code Section 895.11.
each party shall fully indemnify and hold the other party harmless
from any liability imposed for injury Cas defined by Government
Code Section 810.8) occurring by reason of anything done or omitted
to be done under or in connection with any work authority of
jurisdiction under this Agreement
2. Upon completion of the PROJECT, the CITY and COUNTY will maintain
the portions of the work under their respective areas of jurisdiction.
3. PROJECT costs shall include construction costs, any utility relocation
costs which are the responsibility of the public agency and preliminary
and construction engineering costs which shall be prorated between
the CITY and COUNTY based on each agency's share of the total
contract costs.

SUBJECT: COUNTY/CITY OF SAN BERNARDINO COOPERATIVE AGREEMENT - PUMALO AVENUE
(GOLDEN AVENUE TO DEL ROSA AVENUE)
RECOMMENDATION: Approve cooperative agreement between the County and the
Ci ty of San Bernardino for heater scarifying and resurfacing of Pumalo
Avenue from Golden Avenue to Del Rosa Avenue. '
BACKGROUND: This is a revision of Agreement No. 86-792 approved by the
Board of Supervisors on August 25. 1986. Following the approval by the
Board the City requested that certain provisions be changed. The changes do
not affect the cost or scope of work.
REASON FOR RECOMMENDATION: Execution of this agreement is needed to set
forth the responsibilities of the County and City in regard to design,
construction, maintenance and funding of the project.
REVIEW BY OTHER DEPARTMENTS: On September 16, 1986 the agreement was approved
as to legal form by Deputy County Counsel Ed Robinson. On September 16.
1986 the agreement was found to be consistent with County Affirmative Action
policies by the Department Contract Compliance Officer.
FINANCIAL DATA: The total cost of the proposed project is estimated to
be $32,000. The County's share of the cost is estimated to be $19,200 and
will be funded from the 1986-87 County Road Fund Budget.
