CI~ OF SAN _RNARDOo - R.QU~T FOR COUNCIL acRON STAFF REPORT At its meeting of September 11, 1986, the Legislative Review Committee reviewed the San Bernardino Unified School District's written findings of conditions of overcrowding. Resolution No. 85-337 requires the annual submission of such findings to the City. At its meeting, the Legislative Review Committee also considered the anticipated signing by the Governor of a law which would supersede local regulation of school impaction fees. It was agreed by the Legislative Review Committee and the representatives of the School District that the recommendation to the Council would be that the present provision for the collection of fees, and the present amount of such fees, be continued to the first Council meeting in 1987. It was surmised that by that date either the new law would be in effect or there would otherwise be more information available on which to base an evaluation of any changes to the current City resolution. The new law has been signed by the Governor and is to take effect on January 1, 1987. The resolution before you is, therefore, an interim measure to require payment of school impaction fees until January 1, 1987, pending further review. urgency: The resolution establishing school impaction fees for the San Bernardino City Unified School District was only for the 1985- 1986 school year, this resolution is needed to continue the school impaction fees until January 1, 1987, to mitigate impacts of new residentail development on local schools. 15.026_ o o o o 1 RESOLUTION NO. 2 RESOLO~ION OF THE CITY OF SAN BERNARDINO ESTABLISHING THE AMOUNT OF SCHOOL FACILITIES FEES TO BE PAID TO THE SAN BERNARDINO 3 CITY UNIPIED SCHOOL DISTRICT POR EACH DWELLING UNIT WITHIN THE MUTUAL BOUNDARIES OP THE CITY AND THE DISTRICT PENDING FURTHER 4 REVIEW. 5 WHEREAS, on October 6, 1986, following review of the 6 Notification of Conditions of Overcrowding submitted by the San 7 Bernardino City Unified School District, the Mayor and Common 8 Council did determine that there is clear and convincing evidence 9 that conditions of overcrowding presently exist within the San 10 11 Bernardino City Unified Schol District, and WHEREAS, on August 19, 1985, the Mayor and , -'. - ~~",-};.. ..;>.- '"-. ~iJ'~~)1" - , .. ,"'~ to; ;:. , C~b.e6l1AeU 12 adopted Resolution No. 85-325 which establishes the procedures 13 for determining the school facilities fee to be paid to ~SaR 14 Bernardino City Unified School District for each dwelling unit 15 within the mutual boundaries of the City and the District and 16 Resolution No. 85-337 established the basis for such fee, 17 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON 18 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 19 SECTION 1. The Mayor and Common Council accepts the District's a~ermination of the cost of housing each student at .~: $2,.61 as reaaonable for purposes of establishing the school facilities fee herein. SECTION 3.
