Dear Mayor Wilcox:
Enclosed is the Rialto Unified School District Declaration of
Continuing Impaction for the current year. A hearing concerning
this report was held on September 24, 1986, at which time the
Board of Education accepted its findings.
All fees, cost estimates and formulas in the report are calculated
at last year's rate without inflation factors. Enrollment and housing
data presented in the report are current as of September 12, 1986.
Legislation signed by Governor Deukmejian on September 18, 1986,
effective January 1, 1987, wi II divert authority for levying school
facility fees on residential, commercial and industrial. development
projects to the Board of Education of the local school district if
Proposition 53 passes in November 1986.
A resolution of the Board of Education concerning the levying of
fees will be on the October 22, 1986 agenda. The action taken
at that meeting will be effective January 1, 1987 if Proposition
53 passes in November 1986.
We request that the enclosed Declaration of Continuing Impaction
Report be accepted. It is our intent to request a change to Mitigation
Fees in lieu of SB201 fees if Proposition 53 does not pass.

Pursuant to Government Code Sect I on 65971. the Board of Educat Ion of the
Rlalto Unified School District submIts to the City of Rlalto. City of Fontana.
City of Colton, City of San Bernardino. and the County of San Bernardino
this Notification of Condition of Overcrowding as determined following a
public hearing held September 2~. 1986.
The decision to reflle this Notification of Condition of Overcrowding is
based on the following:
I. Overcrowding exists due to the occupation of newly constructed homes

2. Within the boundaries of Rlalto Unified School District there are currently
2,203 dwell ing units (single fami Iy and multi-fami ly) under construction.
Another 3,823 single family and multi-family units have received tentative
or final map approvals from the various cities or counties within this
District's boundaries.
In addition to temporary faci I ities, the following reasonable methods are
used or have been considered to mitigate conditions of overcrowding:
1. Agreements between a developer and the affected school district whereby
temporary-use buildings will be leased to the school for an Interl.
period. or whereby tellpOrary-use buildings owned by the school district
will be used:
No leasing agreements currently exist between developers and the District.
The D i st r I ct does not have temporary bu i I dings that are not current I y
in use. All temporary buildIngs in the District have been planned for
student use.
2. The availability of funds. the use of which would not IlIIpalr the norM I
functioning of educational progr..s:
There are no District funds available, the use of which would not impair
the normal functioning of educational programs.

One school sIte (Maple Avenue site) will be sold as surplus property
because It is not usable for an elementary school, due to Its proximity
to the R I a 1 to A I rport. To rep I ace th Is site, the State purchased the
future Simpson Elementary School property, with the condition that money
from the sale of the Maple site be applied to the Simpson project.
(Simpson School Is being funded through the State School Building
Program. )

,. The use of school district property for temporary-use buildings:
As of September 24, 1986 the Rlalto Unified School District Is utilizing
sixty-five temporary-use buildings at elementary and secondary sites;
5. The use of other schools In the district not having overcrowded
conditions:
Elementary and secondary student transfers have been accomplished and
will continue In order to utilize classroom space as available.
6. Double or staggered sessions:
Past experience has indIcated double sessions reduce the educational
program for students. MInimum day schedules must be established to
house students on double sessions. Double sessions require a reduction
in the amount of time the student spends in class. In addition some
subject areas receive cursory treatment or are eliminated. Finally double
sessions overload existing school facilities and Increase transportation
costs.
Under Education Code Section 46202, if the governing board of a school'
district offers less Instructional time than the amount of instructional
time fixed for the 1982-83 fiscal year, the Superintendent of Public
Instruction shall reduce the distrIct's apportionment by the average
percentage increase In the base revenue limit for district's units of
average daily attendance. Reduction of Instructional time necessary
to Implement double sessions would cause the District to be assessed
a severe financial penalty.

school (multi-track) program. One junior high operates a single-track
year round school program.

10. Use of Interdlstrlct attendance agreeBents:
The Rialto Unified School District has Interdlstrlct attendance agreements
affecting approximately 110 students In 1986-87 school year. Neighboring
districts are impacted, and therefore the granting of Interdlstrlct
agreements are for students with specIfic needs.
11. The elimination of low prIorIty on school facility uses:
Programs which do not require a full classroom have already been relocated
to smaller spaces which are Inadequate for regular classroom use. These
programs Include speech therapy, psychological evaluation, resource
specialist programs for the learning handicapped, Instrumental music
and adaptive physical education.
12. The filing of appropriate notices of overcrowding with cities withIn
attendance areas subject to overcrowding:
This notice wi 11 be filed before October 15. 1986 with all entities
within the Rlalto Unified School District boundaries, as follows:

1. Based upon capacity and projected enrollment, the following schools will
be Impacted and their attendance areas overcrowded by October 1987:

2. In considering reasonable methods of mitigating conditions of overcrowding,
the District concludes that there is no feasible method for reducing
the conditions of overcrowding. The Rlalto Unified School District hereby
requests the County of San Bernardino, City of Rialto, City of Fontana,
City of Colton, and the City of San Bernardino to concur with District
findings of impaction and require the collection of fees from bui lders/
developers. Said fees would be used for the purpose of placing Interim
classroom and restroom facilities on existing school sites determined
to be overcrowded by the District and llsted above. In addition, we
are requesting that an ordinance be adopted that would allow mitigation
fees in lieu of SB201 fees.
It is further requested that fees be based upon costs submitted (as attach-
ments to impaction package) using the formula stipulated by County
Ordinance 2429.
3. It is the finding of the Board of Education of the Rlalto Unified School
District, and based upon current data, each new single dwelling unit
produces .74 students, and multiple family dwellings produce .45 students
per uni t.
