STAFF REPORT
On September 22, 1986, the Southern California Gas Company appeared before the
Commission to voice their concerns regarding the prohibition of outdoor storage in
the Overlay Zone in Central City South. They would be able to continue their
present uses as an existing nonconforming use unless they wished to rebuild or
remodel their building. They expect to extensively remodel the building within a
few years and wish to continue their current outdoor uses.
As directed, staff has negotiated with Company offcia1s to find a satisfactory
method of obtaining the objectives of all concerned. Specific mention in the
enabling ordinance would be spot zoning and is not recOllllllended. A continuance in
the adoption process would leave the City exposed since the moratorium has expired
and that also in not recommended. The initial position of the Company was a
request for total exemption from the outdoor storage standards and that would be
unfair to surrounding property owners as new development proceeds in the Zone.
A compromise has been reached involving a proposed OPA that uses screening
techniques s1mular to the Wixen project previously approved by the Commission.
Staff would negotiate the specific language of the agreement in the next few weeks
and the OPA could be adopted during the Commission meeting on November 3, 1986
before the Overlay Zone ordinance becomes effective on November 5, 1986.
The attached resolution would direct staff to proceed and would provide the Gas Co
with a commitment by the Commission to reach an accord using the proposed
standards. This would allow the Mayor and Council to proceed with the adoption of
the Overlay Zone ordinance today.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO DIRECTING
NEGOTIATION OF DEVELOPMENT AGREEMENT WITH SOUTHERN CALIFORNIA GA
COMPANY.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Recitals.
A. Representatives of the Southern California Gas Company
have expressed concern that the proposed Overlay Zone for the
Central City Study Area would have significant detrimental
effects upon its facility located at l55 South -Gw Street,
primarily because of the company's ongoing need for outdoor
storage of materials and supplies. The company generally
supports the concepts involved in the Overlay Zone, and does not
desire to oppose the establishment of the zone, but has special
concern about its needs for being able to deal with emergency
situations.
B. Representatives of Southern California Gas Company have
met with members of the City staff and Redevelopment Agency
staff, and are satisfied that a development agreement can be
negotiated to meet the needs of that company, prior to the
effective date of the Overlay Zone ordinance, provided that the
Mayor and Common Council will approve in concept such a
development agreement and establish guidelines therefor.
C. City and Agency staff have indicated that development
guidelines substantially like those established for Wixon Pipe
and Supply Company, but without the extra extension required on
the wall or fencing, would enable the City and Agency to provide
adequate screening for the company's site, in a manner not
detrimental to the overall purposes of the Overlay Zone.

SECTION 2. Implementation. The Mayor and Common Council
approve in principle the concept of a development agreement
between the City and Southern California Gas Company relating to
its property at 155 South RGn Street, in the Central City South
Study Area, and direct the Planning Director, Redevelopment
Agency staff, and the City Attorney's Office to negotiate with
Southern California Gas Company for a development agreement
imposing standards for site screening of the property at l55
South RGR Street similar to those standards heretofore approved
for Wixon Pipe and Supply Company, but without the requirement
for extension above the proposed wall, or for an unusually high
fence. Such agreement is to be presented to the Mayor and Common
Council for consideration not later than November 3, 1986.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a meeting thereof, held on the
