ORDINANCE AMENDING MC CHAPTER 19.12 PERTAINING TO MULTIPLE FAMILY RESIDENTIAL DISTRICT - The Committee recom- mended that the definition of .story. in the Uniform Building Code be adopted. Maximum building height shall not exceed 35 feet. Additionally, there will be no R 3-1200 zoning after the effective date of the ordinance but property already zoned R 3-1200 would be grandfathered under the old guide- lines. The City Attorney and Planning Director were directed to draft the proposals agreed upon and present to the Council for approval. 2. PARKING REQUIREMENTS FOR MEDICAL AND DENTAL OFFICES The Committee recommended that the standards for calcu- lating the parking requirements for medical and dental offices be ten spaces for the first 2000 square feet of floor area, plus one space per 175 square feet of the remaining gross floor area. The Committee further recommended that the Planning Director place the recommended standards on the next Planning Commission agenda for their recommendation to the CElJBIII~ -3:' ORDINANCE OUTDOOR SALES/AUTO SALES AND STORAGE AUTO ACCESSORIES - The Committee recommended that a separate ordinance be drafted. The Planning Director was directed to contact the spokesperson for the automotive dealers to incor- porate their recommendations for Committee consideration. 4. WAIVER OF BUILDING FEES - WESTERN REGIONAL LITTLE LEAGUE - Councilman Quiel requested the Committee consider waiving building permit fees, in the amount of $6,853.41, for the Western Regional Little League building at 6707 Little League Drive. RESOLUTION AUTHORIZING CITY ADMINISTRATOR TO ACT AS A REPRESENTATIVE OF THE CITY TO APPLY FOR DISABILITY RETIRE- MENT - Tabled. 7. REQUEST FOR WAIVER OF STORM DRAIN FEES - TRACT NO. 10979, EAST OF PINE AVENUE AND NORTH OF IRVINGTON AVENUE The Committee received a report from Councilman Quiel and agreed that the Director of Public Works/City Engineer needs a policy guideline rather than an ordinance to permit instal- lation of storm drains over and above normal development by a developer. There would not be a waiver of fees but a par- ticipatory agreement to refund the developer a cost not to exceed the amount of storm drain fees paid. If there is a downstream requirement foreseen, the City would not make a refund. The Committee recommended that the City Engineer bring the policy guidelines to the Council for approval. III . . o o o LEGISLATIVE REVIEW COOTTEE ITEM No. 7 GUIDELINES for PARTICIPATION BY THE CITY IN THE COST OF CONSTRUCTION OF MASTER PLAN STORM DRAIN FACILITIES BY DEVELOPERS I. PURPOSE--To provide for participation by the City in the cost for construction of inordinately large Master Plan Storm Drain facilities, where the City has no downstream responsibilities. II. DESCRIPTION --It is the intent of the City of San Bernardino that Master Plan Storm Drain facilities be constructed in order to provide protection from flooding. These facilities are normally constructed by developers, or by City Public Works contracts fina~ced with storm drainage fees paid when building permits are issued. It is recognized that on occasion developers are required to install facilities larger than usually considered necessary for local drainage, and the City has no downstream responsibilities by virtue of the fact that these facilities discharge into a channel or basin under another agency's jurisdiction. III. PROCEDURE--Any developer required to install a Master Plan Storm Drain facility of a secondary nature (60 inch or larger pipe), may submit a request for participation by the City to the Director of Public Works/City Engineer. Upon making and finding that the required facility is of a secondary nature, and that the City has no downstream drainage responsibilities, the Director of Public Works/City Engineer will submit an agreement for participation by the City to the Mayor and Council for approval.
