STAFF REPORT
The history of this item is contained and attached as a part of the findings.
The Board of Building Commissioners heard this item May 2, 1986, and granted
90 days to complete construction (the slab having been poured). This included
and coincided with a 90 day continuance. September 5th the item was returned
to BBC due to no progress. The Board ordered demolition, if permits were not
drawn or appealed in 10 days from posting. The appeal is an appeal of the
order to demolish.
A meeting with Mr. Bair on Friday, September 26, resulted in the following
proposal:
Mr. Bair is to provide all revisions, and a specific time frame for construction
of the unit to Building and Safety if the appeal is upheld.
The alternatives are:
Uphold the findings and decision of the Board of Building Commissioners
dated September 5, 1986.
rant the appeal subject to the following conditions; (1) all up to date
nd current plans be submitted to the Building and Safety Department within
10 calendar days of this date; (2) a specific time frame, as submitted, or
as modified by Conmon Council, be imposed; (3) applicant agrees to not
contest in any way. an immediate order of demolition if work is not sub-
stantially completed by end of agreed, upon time frame.
3. Grant the appeal without condition.
4. Continue the matter to a time certain.

DECISION TO ABATE PUBLIC NUISANCE ~ 5718 NORTH
"D" STREET ~ TED D. BAIR ~ CONTINUED FROM
JUNE 3, 1985
This is the time and place continued to for reconsid~
eration of the Mayor and Common Council's decision to
abate a public nuisance at 5718 North "D" Street, on prop~
erty owned by Ted D. Bair. (13)
Council Member Quiel made a motion, seconded by
Council Member Strickler and unanimously carried, to close
the hearing and reverse the decision of the Building Com-
mission.
HIGHLAND HILLS PROPERTIES - PARCEL MAP NO. 9166 -
HIGHLAND AVENUE AND ORCHARD ROAD
Council Member Marks made a motion, seconded by
Council Member Reilly and unanimously carried, to con-
sider Highland Hills Specific Plan Amendment No. 82-1.
Planning Director Schuma explained previous action
taken relative to the Highland Hills properties and pre-
sented a resolution to implement the recommended action.
RES. 85-236 - RESOLUTION OF THE CITY OF SAN
BERNARDINO APPROVING AMENDMENT NO. 1 TO
SPECIFIC PLAN 82-1 OF THE CITY OF SAN BER-
NARDINO.
PUBLIC HEARING - TEFRA - CAL-SHEL PROJECT -
SHANDIN HILLS - NORTH SIDE OF KENDALL DR. -
WEST OF LITTLE MOUNTAIN -
, This is the time and place set for a public hearing
to consider the application for financing in the amount of
$25,000,000 (originally $32,000,000) by Cal-Shel (formerly
Carousel Development & Associates) under the Tax Equity
and Fiscal Responsibility Act (TEFRA). The proposed proj-
ect is located in Shandin Hills - on the north side of.
Kendall Drive approximately 1 1/2 miles west of Littl~
Mountain Drive. (R-20)
Chairman wilcox opened the hearing.
Senior Assistant City Attorney Briggs answered ques-.
tions regarding the inclusion of density bonus, provisions
in resolutions.
Council Member Marks made a motion, seconded by
Council Member Hernandez and unanimously carried, that the
attorneys be directed to incorporate a standard phrase in
all resolutions where a density bonus or zoning/General

hearing on the appeal was continued to Monday, October
6, 1986, in the Council Chambers, 300 North "D" Street,
