OF SAN BERNARDII.> - REQUE. FOR COUNCIL AC,.,N . C> c 75-0264 STAFF REPORT Insufficient Bpace at 303 EaBt Third Street is causing the relocatiOn of the Fourth DiBtrict Court of Appeal. Several months ago, RiverBide officia1B hOBted a luncheon for the jUBtices and pitched various faci1itieB. The IBM building there seemed particularly attractive and there haB been an indication space waB being held for them. . Meanwhile, efforts have been underway to retain the court in San Bernardino and several building owners and developers are making proposa1B. A tour by tbe jUBticeB and luncheon with the Mayor is planned for mid to late October. Senator PreB1ey'B Bill, SB 440, waB amended through the effortB of ABsemb1yman Bill Leonard to allow for the Court'B relocation in the .San Bernardino/RiverBide area. (it was originally provided for relocation to Riverside). We understand the Governor has or will soon sign the bill. Our information is: 1. The Court is quite eager to relocate in more suitable quarters to overcome numerouB deficiencieB in their existing Bpace. 2. The justices appear to be much more intereBted in the quality and Buitability of the quarters than the question of location between here and Riverside. 3. We believe that, with some 1imitationB impoBed by State procurement practiceB, the jUBticeB' deBireB will be a key point in ultimately determining the location. The justices' requirementB are 'approximately 20,000 Bquare feet with a minimum of 15,000 on a single floor. We have heard that the IBM building no longer haB two contiguous f100rB which would make it Bignificant1y lesB attractive for Becurity and administrative reasonB. The State is looking for a lo-year lease. Although the State I18Y be willing to pay aB IIUch aB *500,000 per year for rental and amortization of tenant improvementB, there will be a competition in which price will be a definite factor. Still, the jUBticeB are interested in a firBt-rate facility. Any construction of new facilities would need to be imminent aB the justiceB do not prefer to wait for an extended time. SECTION 2. Imolementation. The City of San Bernardino urges the California Court of . Appeal, the Government of the State of California, and all state officials interested in the welfare of the citizens of San Bernardino County to support the relocation of the Fourth District Court of Appeal to other facilities within the downtown area of the City of San Bernardino. The City also urges State Assemblymen Gerald Eaves and William Leonard and State Senator Ruben Ayala to lend their support and encouragement to the retention of this service in the downtown area of San Bernardino. The City further commits its staff to providing all reasonable assistance to court officials and staff and to other state personnel in locating and arranging transfer of operations into other suitable court facilities in the downtown San Bernardino area.
