On November 4, 1985, the Mayor and Common Council approved and adopted Ordinance MC-48l, establishing incentives to be granted certain businesses and certain residential construction declaring the urgency thereof. On July 7, 1986, the Mayor and COIIIIIlon Council approved in principle, that the WestCom Development site be authorized to receive the benefits and incentives identical to those associated with the benefits and incentives of the commercial sub-areas of the Enterprise Zone. On August 4, 1986, the Mayor and Common Council approved changes to Chapter 3.18.060 of the Municipal Code relating to rebates in the industrial area of the Enterprise Zone. They Mayor and Common Council also approved the granting of incentives to WestCom Development and amended the commercial zone of the Enterprise Zone accordingly. On August 18, 1986, the Mayor and Co_on Council approved vscant parcels zoned for multifamily use which otherwise qualify as infill housing sites located within the City's Enterprise Zone and included within the five (5) priority areas as part of the City's Infill Housing Program. On September 8, 1986, the Mayor and Common Council adopted: a) First Reading - Ordinance amending Enterprise Zone to include multifamily, to clarify industrial area rebate and to exempt cultural development fees from commercial area. b) Resolution #86-354 amending boundaries of commercial area. c) Resolution #86-353 amending 85-337 to provide that multifamily infill not exceed four (4) units, shall be exempt from school impaction fees. l552G/SL 09/22/86 , CI10 OF SAN BERNARDIO - REQUEQ" FOR COUNCIL ACON c o o 75-02" STAFF REPORT On September 9, 1986, the Mayor and Common Council held the first reading of an ordinance which would provide for the following: a) Multifamily Include Multifamily within the Enteprise Zone (not to exceed four (4) dwelling units per lot). Vacant parcels zoned for multifamily, which otherwise qualify as infi11 housing sites are to be included as part of the Infi11,Program. b) Industrial Clarification For clarification proposed, the Ordinance amendment provides that during the first year of operation of any new industrial business (within industrial zone), the City shall provide specified rebates - during the first four (4) years of the life of the zone. c) Cultural Fees Exemption The Ordinance amendment provides that any new or expanding business, within the commercial area, shall be exempt from the recently adopted cultural fees. For your clarification and background, we have included below the sections of the staff report submitted on September 8, 1986, relating to the above amended sections: a) Multifamily On October 14, 1985, the Mayor and Common Council adopted Resolution Number 85-405 approving the establishment of the City's Infi11 Housing Program and set aside *2 million from the City's 1985 Single Family Mortgage and Revenue Bond Allocation to provide permanent financing for the infi11 homes. Agency staff were directed to develop an infi11 housing program and implementation strategy for council approval. Since that time, the program and implementation strategy has been approved by the Mayor and Common Council. Additionally, staff was recently instructed to develop and issue a request for proposals (RFP) for the purpose of inducing additional developers to participate in the program. During the RFP process, several potential respondents brought it to the attention of staff that the program specified single family dwelling units, whereas a number of vacant parcels that would ordinarily qualify for infi11 assistance are zoned for multifamily construction. This significantly reduces the possibility of development if developers were required to construct single family detached dwelling units on parcels zoned for multifamily development. 1552G/ SL 09/22/86 , ' , CI-R OF SAN BERNARDIAb - REQUE9r FOR COUNCIL AC~N o STAFF REPORT The Redevelopment Committee haa taken the poaition that if the project otherwise qualifies for infill assistance but for the R-l zoning, the current zoning shall apply. Agency Counsel advises, however, that Ordinance NUIIlbered MC-480 and MC-48l must be amended in order to accomplish multifamily construction in the Infill Housing Program. On August 18, 1986, the Mayor and Common Council took action authorizing that vacant parcels zoned for multifamily residences, which otherwise qualify as infill housing sites and are within the Enterprise Zone, be included as part of the City's Infill Program. The action further authorized that the Enterprise Zone Incentive Ordinance be amended accordingly. Clarification ~ Industrial Area b) o In addition to the above housing issue, the Mayor and Common Council has held discussions relating to the appropriate timeframe for incentives approved for the industrial area of the Enterprise Zone. Presently, Ordinances NUIIlbered MC-480 and MC-48l allow for incentives to be provided to businesses in the industrial area during the first year of operation. This incentive is available for the life of the Zone. There has been discussion that is was the intent of the Council to limit the incentive to the first four (4) years of the life of the Zone. On August 4, 1986, Mayor and Common Council approved that Chapter 3.18.060, be amended to read as follows: During the first year of operation of any qualifying new industrial businesses that locate within the industrial area of the Enterprise Zone during the first four (4) years of life of the following: c) Cultural Fee Exemption On August 20, 1986, the Mayor and Common Council held the first reading and considered adoption of an ordinance to amend Chapter 15.57 of the City of San Bernardino Municipal Code. This ordinance will allow the City to collect one-half (1/2) of one-percent (1%) of the construction cost from commercial builders, to be used for cultural development. The final reading and adoption is scheduled for the September 8, 1986 meeting of the Mayor and Common Council. The Mayor and Common Council's consideration of the attached Enterprise Zone Ordinance for adoption will authorize the waiver of said Cultural Development Construction fee for development located in the commercial area of the Enterprise Zone. c 75..02.. l552G/SL 09/22/86 o o . . ~ o 22 Municipal Code is amended to read as follows: 23 24 25 26 FINAL READING o o o 1 ORDINANCE NO. Section 3.18.030, paragraph P of the San 8 Bernardino MuniCipal Code is amended to read as follows: 9 10 family home construction or multi-family housing construction not 11 12 13 14 15 16 17 18 19 -P. 'In-fill housing' as used in this Chapter is single exceeding four dwelling units per lot, built on vacant lots in neighborhoods existing at the time of adoption of this Chapter, or built on lots where existing structures are demolished or removed for the construction of single family homes or multi- family housing. This shall apply as to multi-family housing only for multi-family housing which would otherwise qualify as in-fill housing sites under the policies of the City of San Bernardino and which are located within the boundaries of priority areas numbered 1, 2, 3, ., and 5, as established by the City of San 20 Bernardino.- 21 SECTION 2. Section 3.18.050 of the San Bernardino -For any qualifying new or expanding business which locates or expands in the Enterprise Zone within the first four years of the life of the Enterprise Zone, City shall exempt on a one-time basis from certain fees to qualifying new or expanding businesses 27 located within the Commercial Area of the Enterprise Zone, upon 28 1 " o o o o o o o application, the following: all engineering fees, planning fees, 1 building permit fees, cultural development construction fees, and 2 mechanical fees imposed by the City. Storm drain and sewer 3 capacity fee charges are expressly not exempt.- 4 SECTION 3.
