RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF A FIRST AMENDMENT TO LEASE AGREEMENT WITH THE BOARD
3 OF WATER COMMISSIONERS RELATING TO LEASE OF OFFICE SPACE IN CITY
HALL.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
5 SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. The Mayor of the City of San Bernardino is hereby
7 authorized and directed to execute on behalf of said City a First
8 Amendment to Lease Agreement with the Board of Water Commissioners
9 relating to lease of office space in City Hall, a copy of which is
10 attached hereto, marked Exhibit "A" and incorporated h.e'iti;by
11 reference as fully as though set forth at length.

1 FIRST AMENDMENT TO LEASE AGREEMENT
2 (Office Space in City HaIl)
3 THIS FIRST AMENDMENT TO AGREEMENT is made and entered into
4 this
day of
, 1986, by and between the
5 CITY OF SAN BERNARDINO, a municipal corporation referred to as
6 "CITY", and THE BOARD OF WATER COMMISSIONERS, referred to as
7 "BOARD" .
8 The parties agree as follows:
9 1. Recitals.

(a) The parties hereto entered into a lease agreement
11 dated the 5th day of June, 1972, for rental of office space in
12 City Hall, hereinafter referred to as "the Agreement".

(b) CITY and BOARD now desire to amend the Agreement to
14 increase the total annual rental payment due under the Agreement.
15 2. Amendment of Agreement. The Agreement is hereby amended
16 in the following respect:

(a) The first paragraph of Section 3 of the Agreement
18 is amended to read:
19 "Lessee agrees to pay to Lessor the rental payments
20 due hereunder in an annual lump sum payment on or
21 before July 1st of each fiscal year effective
22 July 1, 1986. The annual lump sum base rental
23 payment, except as otherwise provided herein for
24 rent adjustment, shall be $138,000, calculated at
25 the rate of $1.25 per square foot for 9,200 square
26 feet of leased space. If Board occupies additional
27 space, such additional space shal1 be chargeable at
28 the rate of $1.25 per square foot per month or .

$15.00 per square foot per year."
3. Other Provisions. Al1 other terms, conditions and
covenants of the Agreement shall remain the same and be in
full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this
First Amendment to Agreement on the day and year first above
written.
