Synopsis of Previous Council action:
August 5, 1985, the Mayor and Common Council approved funding of
$250.00 for the promotion of the "Tops in Blue" Show.
August 19, 1985, the Mayor and Common Council adopted Resolution
No. 85-326
Rscommended motion:
Adopt resolution.
JUSTIFICATION FOR PLACEMENT ON THE SUPPLEMENTAL AGENDA:
To allow for immediate funding enabling the preparation of the
program to continue. The scheduled date for the program is
October 15r 1986.

Dear Mayor wilcox & Common Council:
Last October San Bernardino was fortunate to be able to host the
United States Air Force "Tops In Blue" show at the National
Orange Show. The show was a rousing success, and significantly
enhanced the fine relationship and goodwill that exists between
the community, the U.S.A.F., and Norton AFB.
As you well know, it was only through the generous support of
sponsors like yourself that our community was able to underwrite
the support costs, and permit the show to go on. Thousands of
people were treated to a top notch performance.
Once again we have this opportunity to host the "Tops in Blue"
show. The all new 1986 edition will be conducted on October 15,
again at the National Orange Show Pavilion. As you probably
remember, there can be no charge, so we must look to our com-
munity for support. We again respectfully ask you to become a
sponsor. A nominal contribution of $250 would put us well on the
way to ensuring the succes. of this most worthwhile endeavor,
which reflects our continued community involvement and spirit.
Of course, you will be given due recognition for your support.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH THE SAN BERNARDINO AREA CHAMBER OF
COMMERCE RELATING TO FUNDING TO ASSIST WITH THE PROMOTION OF THE
-TOPS IN BLUE- SHOW.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is
hereby authorized and directed to execute on behalf of said City
an Agreement with the San Bernardino Area Chamber of Commerce
relating to funding to assist with the promotion of the -Tops in
Blue- show, a copy of which is attached hereto as Exhibit -A- and
incorporated herein by reference as though fully set forth at
length.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San

THIS AGREEMENT is entered into this

, 1986, at San Bernardino, California, between the
CITY OF SAN BERNARDINO, a municipal corporation, referred to as
.City., and the SAN BERNARDINO AREA CHAMBER OF COMMERCE, a
California corporation, referred to as .Contractor..
City and Contractor agree a& follows:
1. Recitals.
A. City has achieved a very high degree of acclaim in
being selected as an All-America City, and in order to realize
the maximum benefit of this award, it is necessary that it
receive as much publicity and exposure as possible.
B. Contractor is hosting a -TopS in Blue. show, to be
held October 15, 1986, at the National Orange Show Pavilion in
recognition of Norton Air Force Base, and has requested financial
assistance from City to promote and enhance the goodwill and
relationship with Norton Air Force Base.
C. The Mayor and Common Council of the City of San
Bernardino find and determine that it will be for the
convenience, benefit and advantage of the City, and of its
'inhabitants, to assist Contractor in the promotion of the .Tops
in Blue- show.
2. Promotion. Contractor agrees that it will use its best
efforts to promote and publicize the -Tops in Blue- show to be
held October 15, 1986, within the City of San Bernardino, and
that City will be given recognition for its support of the show.

3. PaYment. City shall pay Contractor the sum of TWO

HUNDRED FIFTY DOLLARS ($250.00) to assist Contractor with

expenses incurred in promoting the RTops in BlueR show.

4. ~. The term of the agreement shall commence upon
4
execution of this agreement, and terminate on October 20, 1986.
5
5. Hold Harmless. Contractor hereby agrees to, and shall,
6
hold City, its elective and appointive boards, commissions,
7
officers, agents and employees harmless from any liability for
8
damage or claims for damage, including all claims for personal
9
injury, including death, claims for property damage, and any and
10
all other claims or liability which may arise from Contractor's
11
operations under this agreement, whether such operations be by
12
Contractor or by anyone or more persons directly or indirectly
13
employed by, or acting as agent for Contractor. Contractor
14
agrees to, and shall, defend City and its elective and appointive
15
boards, commissions, officers, agents and employees from any
16
suits or actions at law or in equity for damages caused, or
17
alleged to have been caused, by reason of any Contractor's
18
19 operations hereunder.
6. Amendment. This agreement may be amended or modified

21 only by written agreement signed by both parties and failure on
22 . the part of either party to enforce any provision of this
agreement shall not be construed as a waiver of the right to
compel enforcement of any provision or provisions.
7. Assianment. This agreement shall not be assigned by
Contractor without the prior written consent of City.

8. Notices. All notices herein required shall be in
writing and delivered in person or sent by certified mail,
postage prepaid, addressed as follows:
