a) MOVE TO ADOPT RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN
BERNARDINO AUTHORIZING REIMBURSEMENT TO THE CITY OF SAN BERNARDINO FOR COSTS OF
ACQUISITION OF LAND FOR FORTIETH STREET WIDENING PROJECT BETWEEN MOUNTAIN AVENUE
AND ELECTRIC, UTILIZING FUNDS FROM STATE COLLEGE PROJECT AREA, AUTHORIZING
REIMBURSEMENT FROM NORTHEAST PROJECT AREA, IF ESTABLISHED, AND MAKING CERTAIN
FINDINGS IN CONNECTION THEREWITH.

b) MOVE TO ADOPT RESOLUTION OF THE CITY OF SAN BERNARDINO CONCURRING IN THE FINDINGS
OF THE COMMUNITY DEVELOPMENT COMMISSION THAT THE WIDENING OF FORTIETH STREET
BETWEEN MOUNTAIN AVENUE AND ELECTRIC WILL BE OF BENEFIT TO THE STATE COLLEGE
PROJECT AREA.
c) Motion authorizing City Public Works Department to proceed with
40th Street right of way.

STAFF REPORT
The City is anxious to widen 40th Street from Mountain Avenue to Electric. The
estimated cost of right-of-way acquisition is $225,000. On July 31, 1986 and
August 1, 1986, the Council directed that the Redevelopment Agency pay for the
right of way acquisition.
Agency Counsel has prepared a "Mutual Benefit Resolution" to allow for tax
increments from State College and/or the new Northend Survey Area to be used to
reimburse the City for this expense. Staff and Redevelopment Committee are
seeking your approval.
Real Property Engineer, Lewis Little, is requesting a motion authorizing him to
proceed.

RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE
CITY OF SAN BERNARDINO AUTHORIZING REIMBURSEMENT TO THE CITY OF
SAN BERNARDINO FOR COSTS OF ACQUISITION OF LAND FOR FORTIETH
STREET WIDENING PROJECT BETWEEN ELECTRIC AVENUE AND MOUNTAIN
AVENUE, UTILIZING FUNDS FROM STATE COLLEGE PROJECT AREA,
AUTHORIZING REIMBURSEMENT FROM NORTHEAST PROJECT AREA, IF
ESTABLISHED, AND MAKING CERTAIN FINDINGS IN CONNECTION THEREWITH.
BE IT RESOLVED BY THE COMMUNITY DEVELOPMENT COMMISSION OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Findinas.
A. The City of San Bernardino intends to widen Fortieth
Street between Electric Avenue and Mountain Avenue in the City of
San Bernardino.
B. Fortieth Street is a major commercial right-of-way
providing access for residents of the State College Project Area
to shopping facilities located in the general vicinity of
Fortieth Street between Sierra Way and Waterman Avenue, which are
the nearest shopping facilities available to the majority of
housing which has been established within the State College
Project Area.
C. Other than the shopping facilities on Fortieth Street
between Sierra Way and Waterman Avenue, there are inadequate
shopping facilities available to the current residents of the
State College Project Area, and, although some additional
shopping facilities are presently planned in the vicinity of
Electric Avenue and Fortieth Street, even when those plans reach
fruition, there will still be inadequate access to shopping
facilities to meet the needs of the existing and anticipated
residential facilities being constructed in the State College
Project Area.

1 D. The Community Development Commission finds that widening
2 of Fortieth Street will provide vastly improved access to such
3 shopping facilities, and will provide stimulus to the growth of
4 the State College Project Area and will better serve the present
5 residents of the State College Project Area in meeting their
6 present and future needs.
7 E. That part of Fortieth Street proposed for widening lying
8 easterly of the State College Project Area is outside any
9 existing project area but is within the proposed Northeast
10 Redevelopment Project.
11 F. The Commission finds that the proposed widening of
12 Fortieth Street does provide substantial and immediate benefit to
13 the State College Project Area.
14 SECTION 2. Implementation.
15 A. The Community Development Commission therefore
16 authorizes and directs the staff of the Redevelopment Agency to
17 reimburse to the City of San Bernardino, the actual cost of
18 acquisition of land and right-of-way necessary for the widening
19 of Fortieth Street between Electric Avenue and Mountain Avenue,
20 in an estimated amount of $225,000, with authority given to
21 reimburse the full amount actually expended therefor.
22 B. The Executive Director of the Redevelopment Agency is
23 authorized to advance these funds from the State College Project
24 Area, and, when and if funds are available within the Northeast
25 Project Area to make reimbursement, following the approval of the
26 Northeast Project Area, the Executive Director is authorized to
27 reimburse the State College Project Area for the funds so
