On November 4, 1985, the Mayor and Common Council approved and adopted Ordinance KC-481, establishing incentives to be granted certain businesses and certain residential construction declaring the urgency thereof. ~ On Suly 7, 1986, the Mayor and Common Council approved in principle, that the Westcam Development site be suthorized to receive the beneifts and ~ncentives identical to those associated with the benefits and incentives of the commercial subareas of the Enterprise Zone. On Ausust 4, 1986, the Mayor and Common Counc:1l approved changes to Chapter 3.18.060 of the Municipal Code relating to rebates in the industrial area of the Enterprise Zone. Tbe Mayor and Common Counc:1l also approved the granting of incentives to Westcom Developlllent and amended the commercial zone of the Enterprise Zone accordingly. On Ausust 18, 1986, the Mayor and Common Council approved vacant parcels zoned for multifaaily use which otherwise quslify as infill housing sites located within the City's Enterprise Zone and included within the five (5) priority areas as part of the City's Infill Housing Program. o CI~ OF SAN BERNARD~IO - REQU~T FOR COUNCIL AC~N , ~., , o o 711-02... STAFF REPORT Infill Housing On October 14, 1985, the Mayor and Common Council adopted Resolution Number 85-405 approving the establishment of the City's Infill Housing Program and set aside $2 million from the City's 1985 Single Family Mortgage and Revenue Bond Allocation to provide permanent financing for the infill homes. Agency staff were directed to develop an infill housing program and implementation strategy for council approval. Since that time, the program and lIIplementation strategy has been approved by the Mayor and Common Council. Additionally, staff was recently iuatructed to develop and issue a request for proposals (iFP) for the purpose of inducing additional developers to participate in the program. During the iFP process, several potential respondents brought it to the attention of staff that the program specified single f&ll1ly dwelling unita, whereas a number of vacant parcels that would ordinarily qualify for infill assistance are zoned for IRultif&ll1ly construction. This significantly reduces the possibility of development if developers were required to construct single family detached dwelling units on parcels zoned for multifamily development. The Redevelopment Committee has taken the position that if the project otherwise qualifies for infill assistance but for the R-l zoning, the current zoning shall apply. Agency Counsel advises, however, that Ordinauce Numbered MC-480 and K:-481 must be amended in order to accomplish lRultif&ll1ly construction in the Infill Housing Program. On August 18, 1986, the Mayor and Common Council took action authorizing that vacant parcels zoned for multifamily residences, which otherwise qualify as iufill housing sites and are within the Enterprise Zone, be included as part of the City's Iufill Program. The action further authorized that the Enterprise Zone Incentive Ordinance be amended accordingly. Rehates - Industrial Area 13.18.060 In addition to the above housing issue, the Mayor and COIIIIon Council has held discussions relatiDg to the appropriate timeframe for incentives approved for the industrial area of the Enterprise Zone. PresenUy, Ordinauees Numbered MC-480 and MC-481 allow for incentives to be provided to businesses in the industrial area during the first year of operation. This incentive is available for the life of the Zone. " There has been discusa10n that is was the intent of the Council to limit the incentive to the first four (4) years of the life of the Zone. On August 4, 1986, Mayor and Common Council approved that Chapter 3.18.060, be amended to read as follows: During the first year of operation of any qualifying new industrial businesses that locate within the industrial area of the Enterprise Zone during the first four (4) years of life of the following: , CI.., OF SAN BERNARDlcp - REQUEeJ' FOR COUNCIL AC'ON c . . o o 75-_ STAFF REPORT Cultural Development Construction Fee On August 20, 1986, the Mayor and Common Council held the first readiD& and considered adoption of an ordinance to aaend Chapter 15.57 of the City of San BerDardino Municipal Code. This ordinance will allow the City to collect one-half (1/2) of one-percent (1%) of the construction cost fram commercial builders, to be used for cultural development. The finsl reading and adoption is scheduled for the September 8, 1986 meeting of the Mayor and Common Council. The Mayor and Common Council's consideration of the attached Enterprise Zone Ordinance for adoption will authorize the waiver of said Cultural Development Construction fee for development located in the commercial area of the Enterprise Zone. Westcam Development Project On July 7, 1986, the Mayor and Common Council discussed the .erita of amendiD& the boundaries of the commercial desianated subarea to include the Weatcom Development Project site. The Mayor and Common Council eventually took action to approve in principal that the WestcOll Develo.pment project alte be . authorized to receive the benefits and incentives of the commercial subarea of the Enterprise Zone. On August 4, 1986, the Mayor and COlIIIaon Council approved that t1ie commercial desianated subarea of the Enterprise Zone be amended to include properties on both aides of Kt. Vernon Avenue immediately south of Hiahland Avenue, which includes Weatcom Development project (see map attached to Resolution and labeled Exhibit wl W). Staff recommends adoption of attached Ordinance and Resolutions pertainina to the above referenced action. l427L o o o o o o o 1 ORDINANCE NO. ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER 2 3.18 OF THE SAN BffRNARDINO MUNICIPAL CODE RELATING TO THE ENTERPRISE ZONE TO INCLUDE MULTI-FAMILY HOUSING WITHIN PROVISIONS 3 FOR INFILL HOUSING, TO EXEMPT CERTAIN CONSTRUCTION FROM CULTURAL 4 DEVELOPMENT CONSTRUCTION FEES, AND TO CLARIFY INDUSTRIAL AREA REBATE PROVISIONS TO COMPLY WITH COUNCIL INTENT. 5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 6 DO ORDAIN AS FOLLOWS: 7 SECTION 1. Section 3.18.030, paragraph F of the San 8 Bernardino Municipal Code is amended to read as follows: 9 -F. 'In-fill housing' as used in this Chapter is single 10 family home construction or multi-family housing construction not 11 exceeding four dwelling units per lot, built on vacant lots in 12 neighborhoods existing at the time of adoption of this Chapter, 13 or built on lots where existing structures are demolished or 14 removed for the construction of single family homes or multi- This shall apply as to mUlti-family housing only 15 family housing. 16 17 for multi-family housing which would otherwise qualify as in-fill housing sites under the policies of the City of San Bernardino 18 and which are located within the boundaries of priority areas 19 numbered 1, 2, 3, 4, and 5, as established by the City of San 20 Bernardino~- 21 22 Municipal Code is amended to read as follows: 23 24 25 26 SECTION 2. Storm drain and sewer capacity fee charges are expressly not exempt.- SECTION 3.
