policy be adopted by Council as to the above referenced matter.
It is the opinion of this office that instead an ordinance should
be approved by council.

ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION
15.08.010 CONCERNING THE REQUIREMENT OF GARAGES OR CARPORTS WHEN
A STRUCTURE IS TO BE REHABILITATED.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
6 SECTION 1. Section 15.08.010 is added to the San Bernardino
7 Municipal Code to read as follows:
8 "15.08.010 Rehabilitation of structures.
9 A. Whenever a structure is rehabilitated or repaired and
10 there is a garage or carport on the property or there is evidence
11 that a garage had existed on the property to be used by the
12 occupants of the structure, then such garage or carport shall be
13 repaired or reconstructed in kind to meet all current applicable
14 building codes.
15 B. Whenever a structure is rehabilitated or repaired and
16 a garage or carport existed on the property and:
17 1. The rehabilitation or repair costs to that structure

exceed fifty percent of the fair market value of the structure;
and
2. A minimum of ten feet is available to access a garage;
then the construction of a garage meeting all current applicable
codes shall be required."
