STAFF REPORT
The County of San Bernardino has requested that we participate in the cost of
resurfacing Pumalo Street from Sterling Ave. to Arden Ave. Approximately 67%
of this section is within the corporate limits of the City of San Bernardino.
City portions are Pumalo Street from Sterling Ave. to Arden Ave.
The proposed agreement provides, in general, that the City will act as lead
agency and the resurfacing will be performed by City forces. The County will
reimburse the City for its proportionate share, estimated at $10,830.
The total cost of this project is $33,187. Funding for the City portion will
be from the first $460,000 SB300 funds already received by the City.
Pumalo Street from Sterling Ave. to Arden Ave. is badly in need of rehabilita-
tion. We recommend the agreement to be 'approved. .

4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:

SECTION l. The Mayor of the City of San Bernardino is hereby
authorized and directed to execute of behalf of said City an agreement
with the County of San Bernardino relating the the resurfacing of Pumalo
Street from Sterling Avenue to Arden Avenue, a copy of which is, attached
hereto, marked Exhibit "A" and incorporated herein by reference as fully
as though set forth at length, but such award will be effective only upon
the contract being fully signed.
SECTION 2. The contract authorized by this resolution shall not
take effect until fully signed and executed by both parties. Neither
party shall be obligated hereunder unless and until the contract is
fully executed and no oral agreement thereto shall be implied or authorized.

IT IS HEREBY AGREED AS FOLLOWS:
IUse space below and additional bond sheers. Set forth service to be rendered, amount to be paid, manner of payment, time
for performance or completion, determination of satisfactory performance and cause for termination, other terms and
conditions. and attach plans. specifications, and addende, if any.)
WHEREAS, COUNTY and CITY desire to cooperate and jointly participate in
a project for heater remix treatment and resurfacing of Pumulo Avenue from
Sterling Avenue to Arden Avenue hereinafter referred to as PROJECT; and
WHEREAS, PROJECT is partially in the unincorporated area of the COUNTY
and partially within the incorporated area of the CITY, and will be of
mutual benefit to the COUNTY and CITY; and
WHEREAS, COUNTY and CITY desire to set forth the responsibilities and
obligations of each agency in relation to the performance of the proposed
resurfacing.
NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
CITY SHALL:
I. Act as the Lead Agency in the design and construction of the PROJECT.
2. Bear responsibility for the cost of the portions of the PROJECT
lying with the incorporated area of CITY. Said cost is currently
estimated to be $22,357.
3. Provide specifications and estimates to County and obtain a no
cost permit from County prior to advertising for bids.
4. Require its contractors to maintain Worker's Compensation Insurance
on all employees and a Public and Property Liability Insurance
Policy of not less than $1,000,000 combined single limit liability
coverage for bodily injury and/or property damage which shall
name the County and the City of San Bernardino as additional
insured parties.

5. Award and administer a contract for the PROJECT.
6. Upon completion of PROJECT, provide a cost anal ysi s showing a
breakdown of the PROJECT costs in the incorporated area of the
CITY and in the unincorporated area of the COUNTY.
COUNTY SHALL:
1. Bear responsibility for the cost of the portions of the PROJECT
within the unincorporated area of the COUNTY. Said cost is currently
estimated to be $10,830 and shall not exceed $13,000 unless approved
by the COUNTY in writing.
Payment of the COUNTY'S share of the costs shall be due 30 days
after submittal of the cost analysis and billing by the CITY.
IT IS MUTUALLY AGREED AS FOLLOWS:
1. Neither party to this Agreement nor officers nor employees thereof
shall be responsible for any damage or liability occurring by
reason of anything done or omitted to be done by the other party
to the Agreement under or in connection with any work, authority
or jurisdiction not delegated to the parties under this Agreement.
It is also agreed that, pursuant to Government Code Section 895.4,
each party shall fully indemnify and hold the other party harmless
from any liability imposed for injury (as defined by Government
Code Section 810.8) occurring by reason of anything done or omitted
to be done under or in connection with any work authority of
jurisdiction under this Agreement
2. Upon completion of the PROJECT, the CITY and COUNTY will maintain
the portions of the work under their respective areas of jurisdiction.
3. PROJECT costs shall include contract payments, any utility relocation
costs which are the responsibility of the public agency and preliminary
and construction engineering costs which shall be prorated between
the CITY and COUNTY based on each agency's share of the total
contract costs.

SUBJECT: COUNTY/CITY OF SAN BERNARDINO COOPERATIVE AGREEMENT - PUMALO
AVENUE (STERLING AVENUE TO ARDEN AVE.)
RECOMMENDATION: Approve cooperative agreement between the County an.d the
City of San Bernardino for heater remix treatment and resurfacing of Pumalo
Avenue from Sterling Avenue to Arden Avenue.
BACKGROUND: The County and the City staffs agree that this road is in need
of heater remix treatment and resurfacing. The project is partly within
each agency's jurisdiction. The City will be the lead agency.
REASON FOR RECOMMENDATION: Execution of this agreement is needed to set forth
the responsibilities of the County and City in regard to design, construction.
maintenance and funding of the project.
REVIEW BY OTHER DEPARTMENTS: On May 15. 1986 the agreement was approved by
Deputy County Counsel Ed Robinson as to legal form. On May 13. 1986, the
agreement was found to be consistent with County Affirmative Action policies
by the Department Contract Compliance Officer.
FINANCIAL DATA: The total cost of the proposed heater remix treatment and
resurfacing project is estimated to be $33,187. The County share of the
cost is estimated to be $10, 830 <33~) and will be funded from the County
Road fund proposed budget for FY 1986-87.
