STAFF REPORT
April 7, 1986, the Mayor and Common Council adopted Resolution No. 86-104,
awarding a contract in the amount of $75,000 to Ed Martin's Discing for
Weed Abatement services within the incorporated limits of the City of San
Bernardino for fiscal year 1986-87.
In past years charges have 'not exceeded this amount. This year emphasis
on citywide beautification resulted in handcleaning and/or removal being
required on almost all parcels. The contractor's charge is $50.00 per
hour for handcleaning (1 hour minimun) and $75.00 for removal (1/2 hour
minimum). Current average charge per residential sized lot for discing
is $35.00.

Costs have tripled mainly because of removing debris, trash, etc. from
indiscriminate dumping and the required handcleaning. There will be no
funding for the Fall Tumbleweed Abatement program scheduled to start in
September if funding is not increased. Abatement work currently sched-
uled will have to be cancelled as well.
All factors requiring the requested increase shall be evaluated in full
and a report filed with the Mayor and Common Council prior to the start
of the Spring, 1987 Weed Abatement program.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING AND
RATIFYING EXECUTION OF THE FIRST AMENDMENT TO THE AGREEMENT FOR
WEED ABATEMENT BETWEEN THE CITY OF SAN BERNARDINO AND ED MARTIN'S
DISCING.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is
hereby authorized and directed to 'execute for and on behalf of
the City of San Bernardino a First Amendment to an Agreement for
Weed Abatement between the City of San Bernardino and Ed Martin's
Discing, effective as of April 15, 1986, and the Mayor and Common
Council hereby ratify the execution of such agreement effective
as of that date. A copy is attached hereto as Exhibit "A".
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San

FIRST AMENDMENT TO AGREEMENT
1 FOR WEED ABATEMENT BETWEEN THE
CITY OF SAN BERNARDINO AND
2 ED MARTIN'S DISCING

4 THIS AGREEMENT is entered into effective the 15th day of
5 April, 1986, between the CITY OF SAN BERNARDINO, a municipal
6 corporation, hereinafter referred to as .City., and ED MARTIN'S
7 DISCING, hereinafter referred to as .Contractor., and amends that
8 certain Agreement for Weed Abatement heretofore entered into by
9 the parties as of the 15th day of April, 1986.
10 SECTION 1. The Agreement is amended by substituting the
11 following paragraph for the last paragraph of Section 3 of the
12 Agreement:
13 .In no event shall the total amount paid to contractor
14 during the term hereof exceed the total amount of $200,000.00 for
15 the services provided. In the event that services are requested
16 which will exceed said limitation, no such work shall be
17 performed without prior written amendment to this Agreement..
18 SECTION 2. In all other respects, the Agreement of April
19 15, 1986 is confirmed and shall remain in full force and effect.
20 IN WITNESS WHEREOF, the parties have executed this
21 Agreement effective as of the 15th day of April, 1986.
