Synopsis of Previous Council action: ow
This property was first;cited October 19, 1981,for construction violations.
Problems have continued. The Board of Building Commissioners first heard this
matter on September 6, 1985, at which time abatement was ordered. The matter
was appealed to the Mayor and Common Council in November and continued to
January, then to March, then referred back to the Board of Building Commissioners
with a report to Council in June, 1986. At the June meeting the matter was con-
tinued to the first meeting in September, 1986.
The problems are excess structure coverage on lot and buildings are not constructed
to Building Codes.
Recommended motion:
If project is not completed by September 27, 1986, the decision of the Board of
Building Commissioners would be in effect.

FINDINGS :
This dwelling and construction project has not been properly inspected. The owner
has called for inspections ,on the bathrooms only. It is unclear as to workmanship
of the project as the inspections have not been called for
Following is the Staff ieport of June, 1986:

Mr. Manuel B. Enriquez is progressing with his building construction as follows:
1. The 2-car carport has replaced the bedroom and bath and buttresses encroaching
in front setback have been removed, but is not,complete.
2. Bathrooms have been re-tiled and plumbing has been corrected for washer and dryer.
Second bathroom is not complete.
3. Concrete block wall has been removed at bathroom and replaced with wood stud
stucco wa 11 .
4. Exterior walls and attic have been insulated.
5. Electrical has been partially rewired.
6. Gas wall heater is vented and installed to code.
7. One water has been correctly installed.
8. Little work has been done on the front part of the building.
9. Mr. Enriquez was in the process of buying the lot on the east side to correct the
lot size problem, but the owner of said lot just died. Mr. Enriquez is trying to
arrange to get with the probate court to complete the purchase.
10. Mr. Enriquez has stopped all work until he can get the results of purchasing the
lot next door as this will direct him to leave or remove the 500 sq, ft. he has
overbuilt.
11. Mr. Enriquez' permit will run out on September 27, 1986.
An inspection was made September 4, 1986. the results being the above items are still
at the same point as noted above. It should be noted that connected electrical wiring
in the carport is exposed to weather. It should be removed. The second water heater
is improperly vented and constitutes a fire hazard. It should be properly vented in
accordance with Uniform Building Code and Unifonw Mechanical Code.

Discussions with Mrs. Enriquez, .through a daughter, indicated no further success in
locating the owners o~acant property on one side, or the heirs of the estate of
the vacant property on- the other side. The purchase of one or the other would
resolve the lot,coverage issue.
The permits and the time to complete the work will expire on September 27, 1986.
The fo11ow~up action would be .abatement by demolition because work has not been
completed, and because of excessive lot coverage.
ALTERNATIVES:
1. If project is not completed by September 27, 1986, the decision of the Board of
Building Commissioners would be in effect.
2. Grant additional time for completion of work by owner.
3. Direct owner to have work done by a specific time and if not completed, allow
Board of Building Commissioners' decision to come into effect.

June 16, 1986, your appeal filed on behalf of Manuel
B. Enriquez on the Board of Building Commissioners'
decision to order the abatement of a structure at
1139 W. 19th Street, was continued to September 2,
1986 for a review of the progress at that time.
The september 2 meeting of the Mayor and Common
Council will begin at ~:OO a.m. in the Council
Chambers of City Hall, 300 N. "0" Street, San
Bernardino.

Permit taken for addition of 3 bedrooms and 1 bath.
6 page correction notice left. Inspector told owner he would have to make
major changes and indicating no inspections made or called for. This
correction letter was sent by Greg Fraga who was Plan Check Engineer for the
Department of Building and Safety and he spoke fluent Spanish. Mr. Fraga had
had conversations with the owner on what needed to be done.
Letter to owner about zoning, R-l zone.
2 page correction letter to owner and noted no inspections called for. Owner
called and spoke to Mr. Fraga about letter.
Notice of Pendency of ADministrative Proceedings filed.
Correction notice left, no corrections made for 10-16-81.
Special inspection made of the building.
3 page correction letter sent and noted no inspections called for. A person
who spoke Spanish was there for the inspection.
Case went to the Board of Building Commissioners.
BBC ordered additions removed and garage converted back.
Sent letter, posted property.
Owner came in and obtained demolition permit.
Letter of appeal received.
Between 9-6-85 and 9-27-85 owner had 2 contractors of his choice come in and
they said the same thing that the Board of Building Commissioners meeting
ordered. The building needs to be demolished to make repairs and major
changes.
This property is in an R-l zone, which allows a maximum coverage of 35%.
This lot is 7,560 square feet, 35% = 2,646 maximum, house is 3,150 square
feet, building exceeds maximum area by 504 square feet.
The garage was enclosed and no new garage was added.
The building was added onto and built too close to property line on the
east and north sides.
Floors are uneven, walls built wrong, plumbing and electrical and mechanical
items are in unsafe condition. The owner has had conversations with both
Spanish speaking persons in this department about the problems at this
property. The owner still has not made any corrections. The conditions
described constitute an imminent danger to life and property.
