STAFF REPORT
On 6/4/84, a City refuse truck rear-ended a vehicle in which
claimants were riding. The property damage portion of the claim
was paid with Council approval in the amount of $2,322.14.
Following the serving of a Summons and Complaint on the City
in 1985 for the bodily injury portion of the claim, the matter
was ordered to arbitration. The Award of Arbitration has been
received, with awards as shown:

This is a case of clear liability on the part of the City.
The City's defense counsel recommends acceptance of the Award.
