2 RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION
NO. 83-201 ENTITLED IN PART "RESOLUTION '. . . MODIFYING FEES FOR
3 PLANNING SERVICES, ENGINEERING SERVICES, AND USES OF BUILDINGS,
SPORTS FACILITIES, AND EOUIPMENT . . .": AND INCLUDING PROVISIONS
4 FOR CONTRACT PLAN CHECKING PROVIDED BY CITY EMPLOYED CONSULTANTS.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
6 SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. Resolution No. 83-201, section 2, Subsection II
8 is amended by adding paragraph I to read as follows:
9 "I. plan Check Services Requested from Consultant

I. At the request of a developer, outside contract
11 consultant services may be provided through the Director of Public
12 Works/City Engineer to perform plan/map check services. Said
13 services shall be made available on a first come, first serve
14 basis subject to the availability of the consultants under
15 contract to the City. Plan checks shall be performed in an
16 expeditious manner, but the City shall not be responsible for any
17 actual time periods for checking or approval.

2. Consultants shall have authority to request support
19 data, calcul,ations, modifications and revisions prior to their
20 approval. The original plans shall be signed by a registered
21 civil engineer employed by the consultant, certifying that the
22 plans are adequate and recommending approval by the Director of
23 Public Works/City Engineer. The consultant shall not have
24 authority to waive or modify conditions established by the Mayor
25 and Common Council, Planning Commission, Environmental Review
26 Committee or Development Review Committee and shall employ
27 established engineering criteria in the checking process. After
28 commencement of the contract plan check, the City shall not assume
29 completion of the check unless there is default on the part of the

1 consultant.

3. Fees - plan check fees for use of outside
3 consultants shall be paid to the City in advance and shall cover
4 the full cost of. the consultants' fees (including over-time costs
5 if over-time is requested) plus twenty percent administrative
6 costs for the City. Inspection fees shall be in accordance with
7 current fee schedules. A deposit of one hundred fifty percent of
8 the total City estimate of fees, in accordance with this
9 resolution, shall be paid prior to services being provided. Prior
10 to City approval of the final plans, all re~aining charges shall
11 be paid in full. In the event the fees exceed the amount of the
12 deposit, all work shall be halted pending further deposits equal
13 to one hundred percent of the consultant's estimated remaining
14 charges. Any surplus funds shall be returryed after plans are
15 approved. The City shall not assume any responsibility to control
16 costs for services provided nor for the total number of plan
17 checks required to satisfy the Plan Check Engineer. Copies of the
18 consultant's billings shall be available fQr inspection by the
19 requester. The City shall review the billings for accuracy and
20 completeness, but shall not attempt to negotiate lesser fees or
21 enter into disputes concerning the actual time required to
22 complete the processing.
23 4. At the discretion of the City Engineer, consultant
24 plan checks may be required due to staff availability or special
25 requirements of the plans. For any consultant plan checks
26 initiated by the City for the above circumstances, the developer,
27 owner or proponent of a project will pay fees in accordance with
28 the schedules contained in this resolutiori."
