bids.

STAFF REPORT
Plans for construction of a cul-de-sac on Piedmont Drive, east of
Victoria Avenue, have been prepared by the Engineering Division, and the
project is ready to be advertised for bids. The plans include a chain link
gate with reduced slats for emergency access and a pedestrian walkway to
Victoria Avenue. The plans have been reviewed by residents of the neighbor-
hood in order to get their input.
Listed below is an estimate of the total project cost:

An amount of $50,000 was included in the settlement on the Indian
Bingo Parlor to finance this item of work.
Before the cul-de-sac can be constructed, Piedmont Drive will have
to be extended to the east. Negotiations are under way with the subdivider
to the south to accelerate the construction of Piedmont Drive. Preliminary
indications are that this proposal is acceptable, provided that the plans for
their entire subdivision are checked on a priority basis.
We recommend that the plans be approved and authorization granted to
advertise for bids. Advertisement for bids will be scheduled so that con-
struction is commenced as soon as the extension of Piedmont Drive to the
east is completed by the subdivider.

STAFF REPORT
Piedmont Drive will have to be extended to the east before a cul-de~
sac can be constructed to close off access to Victoria Avenue.
The Hill Williams Development Corporation has filed Tentative Tract
No. 13329 for the parcel south of Piedmont Drive, and will be submitting a
proposed development on the parcel north of Piedmont Drive in the near future.
Piedmont Drive will be improved by these developments as a normal condition of
approval. However, the improvement of Piedmont Drive wou1d not occur through
the normal development process for several months.
In order to accelerate the improvement of Piedmont Drive, a request
was made to the Hill Williams Development Corporation to allow the City to
construct the extension as soon as the plans and specifications can be prepared.
The attached Reimbursement Agreements were prepared by the Hill Williams
Corporation to accommodate our request.
These Agreements provide, in general, that the City will construct
grading, curbs and gutters, and paving on Piedmont Drive. The Hill Williams
Corporation will reimburse the City for the costs that they would normally
have incurred for the improvement of Piedmont Drive. Any costs above those
normally incurred by the subdivider will be borne by the City.
Sidewalks, street lights and the final 1 inch of paving will not be
included in the City's contract. These items will be installed by the sub-
divider during construction of the adjoining tracts.
Under provisions of these Agreements, the City would be required to
"up front" the funds to finance the extension of Piedmont Drive. A portion
would be later reimbursed by the subdivider.
Funds for the extension of Piedmont Drive are to be provided under
the Settlement Agreement with the San Manuel Band of Mission Indians relative
to the bingo parlor. This agreement has not been finalized but.it is hoped
that this can be accomplished within the next couple of weeks. .
An amount of $50,000 is to be paid to the City upon execution of this
agreement. Four quarterly payments of $62,500 are also to be made within one
year after, the effective date of the agreement. We understand these quarter-
ly payments are to be made from proceeds on the bingo operation.
In order that the extension of Piedmont Drive may proceed without
waiting for the development process, we recommend that these Reimbursement
Agreements be approved.

RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION
OF A REIMBURSEMENT AGREEMENT WITH THE HILL WILLIAMS DEVELOPMENT CORPORATION
RELATING TO THE EXTENSION OF PIEDMONT DRIVE ADJACENT TO TENTATIVE TRACT NO.
13329.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is hereby
authorized and directed to execute on behalf of said City a Reimbursement
Agreement with the Hill Williams Development Corporation relating to the
extension of Piedmont Drive adjacent to Tentative Tract No. 13329, a copy
of which is attached hereto, marked Exhibit "A" and incorporated herein by .
reference as fully ~s though set forth at length, but such award will be
effective only upon the contract being fully signed.
SECT10N 2. Execution and Amendments. This agreement and any
amendments or modifications thereto shall not take effect or become
operative until fully signed and executed by the parties and no party shall
be obligated hereunder until the time of such full execution. No oral
agreements, amendments, modifications or waivers are intended or authorized
and shall not be implied from any act or course of conduct of any party.

As consideration for work performed by the City of San Bernardino, or
his contractor, on the extention of Piedmont Drive, adjacent to Tentative
Tract No. 13329, prior to the development of the tract, The Hill WIlliams
Development Corporation hereby agrees, (subject to the fOllowing conditions)
to reimburse the city for costs normally incurred if the street construc-
tion was to occur concurrently with our development. This agreement shall
become valid upon approval of final plans and recordation of the final
tract map.
<XmITIONS
1. SWPE OF ~
A) Paving reimbursement quantities shall be to centerline of street.
S) Grading for Piedmont Drive would normally be done at the same
time as the tract grading. The grading of Piedmont Drive prior
to the interior lot grading may require additional work on-site.
Any additional grading costs for lots 11, 12, 13, 30, 31, 46,
47 and 48 caused by "out of sequence" grading operations will
be subtracted from said reimbursement amount paid by the developer
to the city.
C) Storm Drain - Required storm drain extensions within Piedmont
Drive for Tract 13329 will be reimbursable. However, if the
extention is not required for Tract 13329, reimbursement will
not be a part of this agreement.
D) Curb and gutter, sidewalk, street light work, trenching for
street light conduit, if installed, will be considered a reim-
bursable item. Cost for asphalt saw cutting and removal, trench
compaction and testing and re-paving of a utility trench, (or
street crossing) that would normally be avoided due to installation
of all utility crossings prior to paving shall be deducted fro:;]
said reimbursement amount paid by. the developer to the city.
(The city may opt to leave the final lift of AC paving approx-
imately 11 inches low so that if this si tuation occurs, the
final course of AC pavement could be placed by the developer
in one continuous operation. The sawcut, removal and patch
would still be non-reimbursable.)
2. DETERMINATION OF UNIT PRICES FOR PAY QUANl'ITIES.
Due to the tendancy of contractor's bid price for public works const-
ruction to be higher than that of bid prices for construction work
done in the private sector, th~ unit prices for pay quantities will
be determined as follows:
A) Pay quanti ties will be determined from plans on file with the
city engineer.

B) Unit prices paid by the developer to the city will be based
upon the following:
1. The developer will submit awroved plans to his contractor
for a formal bid.
2. The contractor will also furnish other previous bids given
to the same developer on similar type work, ie: if pavement
section is 4" A.C. over 6" B.M. on Piedmont Drive, the con-
tractor will submit a previous bid (different project) on
the same item and scope or work (4" A.C. over 6" B.M.).
The substantiating bid will be dated no more than 18 months
prior to start of city construqtion.
3. With the developer's contractor's project bid, contractor's
substantiating previous bids. for similar work, and the actual
contract between Hill Williams Developnent Corporation and
the contractor an equitable unit price that the developer
normally pays for the work will be determined.
4. This unit price times the quantities built (less additional
charges mentioned above) will be the basis for payment of
reimbursement paid by developer to the city. In no case
shall the amount reimbursed by the developer exceed the
amount the city actually paid for the item of work.
3) TIMIN:; OF PAYMENT OF REIMBURSEMENr BY DEVEWPER 'It) CITY:
A) Payment of reimbursement by developer shall be prior to final
approval and acceptance of public street improvements and bond
release by the City of San Bernardino.
B) There will be no payment of interest by the developer to the

Al The city is advised that the site is presently utilized
as a citrus grove. This grove will be maintained as an
operational producing grove until the start of grading for
the development project north of the Piedmont Drive extension.
The city or city's contractor shall be responsible for any
damage to the grove, irrigation facilities, graded irrigation
troughs etc, and repair, replace or relocate said facilities
at their cost. Said repair costs are not a reimbursable
item. -
BI The repair of any irrigation facility damaged during the
construction of the extention of Piedmont Drive shall be
done within a 24 hour period. The city shall contact the
owner immediately at (7141921-0509 to notify him of the
extent of the damage and how and when it will be repaired.
C) Since the location of the intersecting north-south street
within the proposed development north of Piedmont D~lve
has not been established yet. curb and gutter constructed
on the north side of Piedmont Drive will have to be sawcut
and rerroved to accomodate the construction of curb returns,
cross gutter, and spandrel. The cost of sawcut, remval.
hauling, dumping of curb and gutter, and asphalt to accomodate
this construction will be subtracted from the total
reimbursement paid by the developer to the City of San
Bernardino.
