Synopsis of Previous Council action:
2-17-86 --- Work on Phase I-A, Zone A, in accordance with Plan No. 6667, approved
and accepted and final payment authorized at expiration of the lien
period.
3-04-86 Resolution No. 86-76 adopted authorizing execution of Agreement for
development of the Seccombe Lake State Urban Recreation Area.
5-19-86 Plans approved and authorization granted to advertise for bids.
Recommended motion:

STAFF REPORT
Bids for this project were opened at 2:00 p.m. on Tuesday, 7-8-86.
A total of 3 bids were received, ranging from $915,000 to $962,063,
for the Base Bid. The low bid of $915,000 is 1.9% over the Architect/Engineer's
Estimate of $898,022.
Listed below is an estimate of the total project cost, based upon
the actual low bid price:

The tot lot equipment was included as Additive Alternate No.1,
in case the bid price came in under the estimate. Since the low bid is
slightly higher than the estimate, this additive alternate is not recommended
for inclusion in the contract. This equipment can be installed by City Forces
after this project is completed.
The Development Agreement stipulates that the State will provide up
to $988,000 from the 1984 Bond Act Funds to finance the costs incurred for
completing Phase I-A. This Agreement was signed by the State on 3-27-86,
which committed the funds for this project. '
The bids received have been reviewed by the State, and concurrence
in awarding a contract to the low bidder has been given.
We recommend that a contract be awarded for the low bid price.
URGENCY CLAUSE:
. In view of the considerable public interest in completing this recreation
facility, it is considered necessary to award a contract at the earliest
opportunity.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO
VALLEY CREST LANDSCAPE, INC. FOR CONSTRUCTION OF PHASE I-A, ZONE B, SECCOMBE
LAKE STATE URBAN RECREATION AREA.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. Valley Crest Landscape, Inc. is the lowest responsible
bidder for: Construction of Phase I-A, Zone B, Seccombe Lake State Urban
Recreation Area, in accordance with Plan No. 6878, for the total amount of
$915,000.00 for the Base Bid, a contract is awarded to said bidder accordingly,
but such award shall be effective only upon the contract being fully executed

by the parties; all other bids therefor are' hereby rejected; and the Mayor
is hereby authorized and directed to execute said contract on behalf of the
City; a copy of the contract is attached hereto, marked Exhibit "A" and
incorporated herein by reference as fully as though set forth at length.
SECTION 2. Execution and Amendments., This contract and any
amendments or modifications thereto shall not take effect or become operative
until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral
agreements, amendments, modifications or waivers are intended or authorized
and shall not be implied from any act or course of conduct of any party.
I HEREBY CERTIFY that the foregoing resolution was duly adopted
by the Mayor and Common Council of the City of San Bernardino at a
meeting thereof, held on the
