According to Section 41103 of the California Vehicle Code, a
warrant for the arrest of a parking violator may be issued by
the court if proper notice has been given to the registered
owner of the vehicle. Not only must a properly completed
citation be attached to an illegally parked vehicle but a notice
of the parking violation must be served upon the owner, lessee
or renter of the vehicle. Service may be made by mail, postage
prepaid, addressed to the owner, lessee, or renter of the
vehicle at the address shown on the DMV records.
According to Section 41103, the notice must be accompanied by an
unexecuted affidavit of nonowner ship which may be completed by
recipient if he/she transferred the vehicle prior to the parking
violation date. If the owner, lessee, or renter fails to
respond before the expiration of 10 days after the mailing of
the notice, a warrant may be issued for his/her arrest.
Hopefully, these procedures will motivate parking violators to
pay their fines timely in order to avoid arrest warrants.
