2 RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION
NO. 83-201 ENTITLED IN PART "RESOLUTION . . . MODIFYING FEES FOR
3 PLANNING SERVICES, ENGINEERING SERVICES, AND USES OF BUILDINGS,
SPORTS FACILITIES, AND EQUIPMENT. . ."; AND INCLUDING PROVISIONS
4 FOR CONTRACT PLAN CHECKING PROVIDED BY CITY EMPLOYED CONSULTANTS.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
6 SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. Resolution No. 83-201, Section 2, Subsection II
8 is amended by adding paragraph I to read as follows:
9 -I. Plan Check Services Requested from Consultant

1. plan/map check services may be requested to be
11 performed by outside contract consultants. Said services shall be
12 made available on a first come, first serve basis subject to the
13 availability of the consultants under contract to the City. Plan
14 checks shall be performed in an expeditious manner, but the City
15 shall not be responsible for any actual time periods for checking
16 or approval.

2. Consultants shall have authority to request support
18 data, calculations, modifications and revisions prior to their
19 approval. The plans shall be signed by a registered engineer
20 performing the plan check for accuracy and completeness and, in
21 addition, shall be signed by the Director of Public Works/City
22 Engineer. The consultant shall not have authority to waive or
23 modify conditions established by the Mayor and Common Council,
24 Planning Commission, Environmental Review Committee or Development
25 Review Committee and shall employ established engineering criteria
26 in the checking process. After commencement of the contract plan
27 check, the City shall not assume completion of the check unless
28 there is default on the part of the consultant.

1 3. Fees - Plan check fees for use of outside
2 consultants shall be paid to the City in advance and shall cover
3 the full cost of the consultants' fees (including over-time costs
4 if over-time is requested) plus twenty percent administrative
5 costs for the City. Inspection fees shall be in accordance with
6 current fee schedules. A deposit of one hundred fifty percent of
7 the total City estimate of fees, in accordance with this
8 resolution, shall be paid prior to services being provided. Prior
9 to City approval of the final plans, all remaining charges shall
10 be paid in full. In the event the fees exceed the amoun~of the
11 deposit, all work shall be halted pending further deposits equal
12 to one hundred percent of the consultant's estimated remaining
13 charges. Any surplus funds shall be returned after plans are
14 approved. The City shall not assume any responsibility to control
15 costs for services provided nor for the total number of plan
16 checks required to satisfy the Plan Check Engineer. Copies of the
17 consultant's billings shall be available for inspection by the
18 requester. The City shall review the billings for accuracy and
19 completeness, but shall not attempt to negotiate lesser fees or
20 enter into disputes concerning the actual time required to
21 complete the precessing.

23 plan checks may be required due to staff availability or special
24 requirements of the plans. For any consultant plan checks
25 initiated by the City for the above circumstances, the developer,
26 owner or proponent of a project will pay fees in accordance with
27 the schedules contained in this resolution."
