July 14, 1986, the Development Review Team met to review proposals received in response to the UP issued for the proposed supermarket development at !l1scott and Baseline Streets. Those attending included the following: Carl Clemons, Northwest PAC; Harry Jaclts, Northwest PAC; Diclt Botti. Consultant Real Estate Economist; Dan Frazier. Councilman, Sizth Ward; Roger Hardgrave. Director, Public Works/City Engineer; Frank Schuma, Director. Planning Department; and Agency staff persons, Ken Henderson. Sandy Lowder. Jeanne Wayne. Lisa Dicltey and Ezell James. Proposals were received from five (S) Development Corporations and sre as follows: a) Schurgin Development Corporation b) Halferty Development Corporation c) Aleunder Hasll8n Development Corporstion d) Peppertree Shopping Center Corporation e) Westcom Development, Incorporated The proposed review and evaluation criteria were as follows: 1) Compliance with UP submission requirements. 2) Prior esperience in dealing with major tenants with respect to developments of this type. 3) Prior ezperience in the development and preparation of Urban Development Action Grant applications. 4) Prior ezperlence in working with Redevelopment Agencies and participating in RDA-sponsored projects. S) F1nancial strength. capability and ability of proponent to raise debt f1nancing. 6) Strength (qua1ifications and espertise) and depth of developer's staff (project management). The Development Review Team conducted estensive discussion rell8rding the completeness of proposals submitted. In view of the time constraints relating to the submission of a UDAG application, the COlDDlittee detenoined no sdditional information would be requested of the respondents. Utilizing the review and evalustion criteria described above. the Committee is recolDDlending the following to the Mayor snd Common Council: A. That Aleunder Haall8n Development Corporation be granted an esclusive right to negotiate for a period not to esceed ninty (90) days as developer for the pro ject loca ted at !l1scott and Baseline Streets; and. further, that, B. Should an agreement not be successfully negotiated with Haall8n Development Corporation. that Agency staff be authorized to negotiate with Sclurgin Development and/or Ilalferty Development Corporation without issuing a new RFP; and, further. that, o o o 111 o o o C. Inasmuch as a successful UDAG application 18 considered to be an integral part of project financing. the Committee recommends that should a UDAG not be awarded to the City, that Agency staff be authorized to negotiate with the developer with the strongest financial capability. Adoption of the resolution would authorize staff to proceed with the preparation of the UDAG application and afford staff and the developer the mazimum amount of time possible to accomplish same. l259L o o 0 1 2 3 4 5 6 7 8 9 10 11 o o o RESOLUTION NO. RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO TENTATIVELY SELECTING AND GRANTING EXCLUSIVE RIGHT TO NEGOTIATE TO ALEXANDER HAAGEN DEVELOPMENT FOR DEVELOPMENT OF SHOPPING CENTER AT BASELINE AND MUSCOTT STREETS WITH AUTHORITY TO AGENCY STAFF TO NEGOTIATE WITH OTHERS UNDER CERTAIN CIRCUMSTANCES. BE IT RESOLVED BY THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Community Development Commission has reviewed the proposals submitted by five separate developers, proposing various concepts for the development of a shopping complex at the intersection of Baseline Street and Muscott Street in the City of San Bernardino, and has determined that the, 12 proposal, in concept, submitted by Alexander Haagen Development 13 offers the most promise of successful development, although not 14 all aspects of the proposal are acceptable to the Commission. 15 Alexander Haagen Development shall be offered an opportunity to 16 negotiate with Agency staff towards a development agreement. 17 Such negotiations shall be intended to afford adequate time to 18 Agency staff and the developer to explore all reasonable 19 possibilities of developing the center, approaches to such 20 development, the kind and amount of Agency assistance to be 21 offered, and the financial viability of the project. 22 SECTION 2. Alexander Haagen Development is granted an 23 exclusive right to negotiate with the Agency for ninety (90) 24 days, subject only to the following: If Agency staff and 25 Alexander Haagen Development reach a point where the parties 26 agree that there is no further point in continuing discussions, c:J 27 or if the Executive Director notifies Alexander Haagen 28 Development that continued negotiations are meaningless, and o o 0 1 2 3 4 5 6 7 8 9 \0 o o o o offer no potential for a successful agreement, Agency staff shall be authorized to negotiate with other developers, in an attempt to arrive at a viable development package. The priority for such discussions, after negotiations with Alexander Haagen Development are terminated, is established as follows: 1. Schurgin Development Corporation 2. Halferty Development Corporation SECTION 3. The Commission recognizes that a successful Urban Development Action Grant (UDAG) application is considered 10 to be virtually essential to the successful development of this 11 project, and the obtaining of a UDAG should be pursued with 12 13 utmost vigor. However, in the event that a ODAG is not available, Agency staff shall continue negotiations with the 14 developers in the priority established, in an attempt to find a 15 developer with sufficiently strong financial capability to 16 develop a successful and viable shopping center complex at 17 Baseline and Muscott Streets, in accordance with the request for 18 proposals earlier submitted to developers by the Agency. 19 Dated: 20 21 Approved as to form: 22 AGENCY COUNSEL 23 24 By 25 26 27 28 ....
