Synopsis of Previous Commission/Council setion:
On June 16, 1986, during the Community Development Block Grant Public Hearing,
the Mayor and Common Council considered funding for Easter Seals Society and
directed staff to report on potential funding scenarios at the July 7, 1986
meeting.
On July 7, 1986, the Mayor and Common Council considered and approved CDBG funding
in the amount of $25,000 for the Easter Seal Society.

STAFF REPORT
During the fiscal year 1986/1987 COlDIDUnity Development Block Grant Public
Hearing, the Mayor and Common Council considered propossls for funding for the
fiscal year 1986/1987. At the conclusion of the plblic hearing. the Mayor and
Common Council took action to fund certain cOlDIDUnity non-profit agencies and
directed staff to bring back a report on potential funding scenarios for the
Easter Seals Society.
On July 7, 1986, the Mayor and Common Council considered and approved funding
for the Easter Seal Society for Fiscal Year 1986/1986 out of the Fiscal Year
1985/1986 Contingency Account in the amount of $25.000.
The Scope of Services and Operating Budget for the Agency listed above is
attached to the agreement and incorporated by reference as though fully set
forth at length.
Adoption of the resolution by the Mayor and Common Council would authorize and
direct staff to szecute the agreement between the City of San Bernardino and
Easter Seal Society. Inc.

1. Recitala.
(a) Subrecipient has requested financial assistance from City for
fiscal year 1986/1987 from funds available through a cOlllllunity development
block grant from the United Statea of America to City.
(b) Subrecipient represents that the ezpenditures authorized by
this qreement are for valid cOlllDlunity development purposes. in accordance
with federal law and regulations, and that all funda granted under this
Agreement will be used for no purpose other than those purposes specifically
authorized. The apecific purposes and scope of aervices of this particular
grant are set forth in Ezhibit NAN. attached hereto and incorporated into this
Agreement as though fully set forth herein.
2. PaJll8l1ta. City ahall reimburse Subrecipient for allowable costs
incurred under the scope of this qreement and applicable Federal regulations,

4 This budget shall list a11 aources of funding for the program covered by this
5 Agreement, whether from State. Federal, local or private .ources, and shall
6 ' identify which .ources are paying for which specific portions of the program,
i by line-item, to the eztent practicable. No travel ezpenses for out-of-state
8 travel .hall be included in this program unless .pecifically listed in the
9 budget as submitted and approved, and all travel ezpensea to be funded from
10 funds provided hereunder shall be specifically identified as travel upense,
11 which shall be negotiated between Agency and Subrecipient in the budget. Any
12 travel ezpenses incurred by Subrecipient above the budgeted amount or for
13 out-of-town travel shall not be eligible for reimbursement unless the prior
14 written approval of the Ezecutive Director of the Redevelopment Agency of the
o 15 City of San Bernardino. or his or her deaignee, has been obtained. Funds
16 shall be used for purposes authorized by the C~mmunity Development Block Grant
1 i program only, and no portion of the funds granted hereby shall be used for any
18 purpose not speCifically authorized by this agreement. Only net payroll shall
19 be periodically reimbursed by City as an allowable cost. Any amounts withheld
20 by Subrecipient from an employee's pay for tazes. social security, or other
21 withholding and not 1mmediately paid over to another entity, shall not be
22 included as wages or ezpenses eligible for reimbursement as an allowable cost

until such time as the withheld tazes, social security. or other witrilioldingsi
are actually paid over to the entity entitled to such payment. Upon such'
payment and the submission of evidence of such payment to the Redevelopmentl
Agency, auch ezpel18es shall be regarded as allowable cost. and City shalJ
reimburse Subrec1pient for such obligation. A variation in the itemization 01

10% as to any particular line item, shall be allowed. provided the prior
written approval of the Ezecutive Director of the Redevelopment Agency of the
City of San Bernardino 18 obtained, it being understood that the total amount
of the grant shall not be varied thereby. At the end of the term, all
unezpended funds shall be returned to the City by Subrecipient. The parties
intend that grsnt funds be utilized within the time period covered by this
Agreement. and any funda not used shall revert to the City. No reserve for
the future shall be established with the funds escept as may be authorized to
9 .eet commitments made for services provided during the period of this
10 Agreement. but not yet paid for at the conclusion of this Agreement.
5. AccounUq. Prior to the final payment under this Agreement, and
at such other times as I18Y be requested by the Ezecutive Director of the
Redevelopment Agency of the City of San Bernardino, Subrecipient shall submit
to the Ezecutive Director an accoU1lting of the proposed and actual
ezpenditures of all revenues accruing to the organization for the fiscal year
ending June 30. 1987. Financial records shall be ..intained by Subrec1pient
in accordance with generally accepted accounting principles. in a manner whic
permits City to trace the espenditures of funds to source documentation. All
books and records of Subrecipient are to be kept open for inspection at any
time during the business day by the City. its officers or agents, and by any
representative of the United States of America authorized to audit Community
Development Block Grant programs. Standards for financial management systems
and financial reporting requirements established by Attachment NF" and

Attachment NGN of Office of Management and Budget Circular No. 1.-110 shall be
25'1 fully complied with by Subrecipient. Subrecipient acknowledges that the funds
26 provided are federal funds. Subrecipient's financial management system shall
27 provide for accurate, current and complete disclosure of the financial results
o 2R of each program sponsored by this Agreement. It is the responsibility of

9 practices. Subrecipient shall also monitor the program's activities and
10 submit written reports quarterly. or more often if requested. to the EXecutive
11 Director of the Redevelopment Agency of the City of San Bernardino, in
12 accordance with Attachment NHN. Office of Management and Budget Circular No.
13 A-llO. FaUure to provide such quarterly performance reports may prevent the
14 processing by City of Subrec1pient's requests for reimbursement, and may
15

justify temporary withholding as provided for in Paragraph II hereof.
7. Proc:ur_nt

21 the performance of its officers, employees or agents in contracting with and
22' ezpending the Federal grant funds made available to Subrecipient under this
23 Agreement. Subrecipient's officers. employees or agents shall neither solicit

contract for construction or repair using funds provided under this Agreement

shall include a prov1aion for compliance with the Copeland NADti-Xick Back"
Act (18.V.S.C. 874) as supplemented in Department of Labor Regulations (29
CFR. Part 3). This act provides that each contractor or subgrantee shall be
prohibited from indUCing. by any means. any person employed in the
construction. completion or repair of public work. to give up any part of the
compensation to which he is otherwise entitled. Subrecipient shall report all
suspected or reported violations to City. All contracts in escess of
$10.000.00 entered into by Subrecipient using funds provided under this
Agreement shall contain a provision requiring compliance with Equal Employment
Opportunity provisions established by Ezecutive Order #11246 as amended.
9. Pre.,a1J.1Dg Wage !leqnireaent. Any COnstruction contracts awarded
by Sub recipient using funds provided under this Agreement in escess of
$2.000.00 shall include a provision for compliance with the Davis-Bacon Act
(40.V.S.C. 276a to 276a-7) and as supplemented by Department of Labor
Regulations (29CFR). Under this act.

Subrecipient shall place a copy of the current prevailing
detemination issued by the Department of Labor in each solicitation and the
award of a contract shall be conditioned upon the acceptaDce of the wage
determination. Subrecipient shall report all suspected or reported violations
to City.
10. Approval of City of BY Cbaraes; Use of Proara I:nc_. City
reserves the right to require Subrecipient to obtain the prior written
approval of City of any charges or fees to be charged by Subrecipient for
services prOVided under this AgreelDell.t. and of any rules and regulations
governing the provision of services hereunder. Program income represents
gross income earned by the Subrecipient from the Federally supported
activities.
Such earnings esclude interest earned on advances and may
include. but will not be limited to. income from service fees. sale of
cOlllllodities. usage and rental fees. These funds shall be used first for
eligible prograa activities. before requests for reimbursement. or shall be
remitted to the City. Subrecipient shall remit all unspent program income to
the City within thirty (30) days subsequent to the end of the program year
(June 30. 1987). I:nterest earned on funds advanced under the Agreement shall
be paid to the City.
11. Temporary
Withholdina.
The
Ezecutive
Director
of
the
Redevelopment Agency of the City of San Bernardino is authorized to
temporarily withhold the payment of funds to Subrecipient when the EzeCUtive,

Director determines that any violation of this Agreement has occurred. Funds'
shall be withheld until the violation is corrected to the satisfaction of the
Ezecutive Director or of the Mayor and Co_on Council. Subrecipient shall
have the right to be heard by the Mayor and Common Council if Subredpient

] held within 45 days after the funds have first been withheld, provided

Financial records. supporting documents,
4 statistical records. and all other records pertaining to the use of the funds
5 provided under this Agreement shall be retained by Subredpient for a period
6 of three (3) years. at a ainimum. and in the event of litigation, claim or
i audit. the records shall be retained until all litigation. claims, and audit
8 findings involving the records. have been fully resolved. Records for
9 non-ezpendable property acquired with federal funda provided under this
10 Agreement shall be retained for three (3) years after the final disposition of
1] such property.
12 13. Property HaDaanent Standards. Non-ezpendable personal property,
]3 for the purposes of this AgreelD8llt. is defined as tangible personal property,
14 purchased in whole or in part with Federal funda. which has useful life of
15 .ore than one (1) year and an acquisition cost of three hundred dollars
16 ($300.00) or more per unit. Real property means land. including land
]i improvements. structures and appurtenances thereto, escluding movable
]8 machinery and equipment. Non-ezpendable personal property and real property
19 purchased with or improved by funds provided under this Agreement shall be
20 subject to the property Ilanagement standards specified in Attachment NNN of

Agreement and any and all grants and future payments under
whole or in part at any time before the date of completion of this Agreement
whenever City determines that the Subrecipient has failed to comply with the

the proposed termination and the reasons therefore. together with the proposed
effective date. Subrec1pient shall be given an opportunity to appear before
the Mayor and Common Council at the time at which the Mayor and Common Council
are to consider such recommended termination. and shall be given a reasonable
5 opportunity to show cause why, if any eZists, the qreellent should not be
6 I terminated for cause. Upon determination by this Mayor and Common Council
i I that the contract should be terminated for cause. notice thereof. including
8 reasOllll for the determination. shall promptly be given to Subrecipient,
9 together with information as to the effective date of the termination. The
JO determination of the Mayor and Common Council as to cause shall be final.
II lS. Termination for Convenience. City or Subrecipient may terminate

23 charges. ezpenses (including counsel fees), suits or losses, however
24 occurring, or damages. arising or growing out of the use of or receipt of.

INTRODUCTION:
CDBG funds have been used historically to rehab buildings.
make existing facilities accessible and generally to eliminate
architectural barriers to disabled individuals.
As these efforts conclude it has now been determined that the
greatest barrier to handicapped individuals is inaccessibility to
the labor market. Even though the disabled to some extent now have
access to buildings, have appropriate housing and greater physical
freedom they must contend with the barriers to vocational assessment
and job placement.
In response to these critical needs,
requestin~ CDBG funds to provide start-up
vocational assessment center and job club
low income residents.
This project will access the disabled and economically disad-
vantaged to the labor market and will start the process toward eco-
nomic self-sufficiency. A step toward employment will guarantee that
disabled individuals will be able to afford proper health care, proper
housing, adequate nutrition and generally enable them to enjoy good

ASSESSMENT PROCESS:
A variety of methods, over a period of time need to be utilized
in order to gain a complete picture of an individual's skills.
The purpose is the generation of information that is useful in
vocational program planning and career guidance activities.
A comprehensive vocational assessment process should include
informal procedures, such as: interviews and structured observation of
work performance. Additionally formal procedures such as: vocational
interest inventories, multi-aptitude test batteries, commercial work
samples and vocational aptitude test batteries are required for an
effective vocational profile.
ASSESSMENT GOALS:

aptitudes, and job-specific skills.

ASSESSMENT TOOLS:
Those assessment tools, methodologies, techniques etc. currently
being developed by the Employment Preparation Division of the State
Department of Education will be utilized in the Easter Seal Assessment
Center.
Additionally, the Vocational Assessment Model for students served
by educational and job training agencies has been ordered through
VOICE. This contemporary model is sponsored by the California State
Job Training Coordinating Council and the California State Department
of Education.
The assessment is intended to be used for determining the education,
trainin~, job and supportive services that a participant needs in order
to obtaIn and keep a job.
JOB SERVICES:
Following the Vocational appraisal and a atudy of the client's
education and work history, a client may be recommended for the job
club. This will provide the client training on how to find a job,
how to prepare applications and resumes, how to interview, followed by
the supervised self placement aCitivities. Job attitude will also be a
targeted area to strengthen or modify.
