Procedure to Amend the Interim Policy Document Mayor and Council Meeting - June 20, 1988 REOUEST The Mayor and Common Council are being requested to establish a procedure for the amendment of the Interim Policy Document approved on May 23, 1988, and revised on June 6, 1988. ' BACKGROUND In order to comply with the restrictions imposed by the State Office of Planning and Research in granting the City's first General Plan Extension, the City was required to approve an Interim Policy Document, including a Preferred Land Use Alternative map. This was approved on May 23, 1988, revised on June 6, 1988, and forwarded to the State for approval. When approved by the State, the Interim Policy Document shall determine how land use decisions will be made during the interim period between approval of the Second General Plan Extension and the adoption of the General Plan. Section IV, number 25, of the document allows the Mayor and Common Council to make changes to and clarifications of the policy. During the coming year, in addition to technical errors which may have occurred on the map and the need for clarification and interpretation of the policies, there are also individual property owners who are not satisfied with the designations on the Preferred Land Use Alternative map or with the policy provisions. In that the Mayor and Common Council shall be allowed to make modifications, it is anticipated that there will be requests to make changes during this interim period. A decision to allow individuals to request amendments could result in essentially "rehearing" much of the testimony that the Mayor and Council have already heard. PREAPPLICATIOlt r::.Q~f~.~~CE It is required that the applicant discuss his proposal with a member of the Future Planning D.ivision of the Planning Department prior to filing. This discussion should cover in detail the applicant's request and the procedural steps required. B. .FIL.I.!l<L REOUI REMENTS 1. Application Form Two copies of the application for Amendment to the Interim Policy Document shall be filled out and signed by the L~~~~ ~~Dg owner are to be submitted. All applications shall contain the signature of the legal property owner(s) or a notarized letter signed by the legal owner(s) authorizing a third party to represent vested interests. This applies even though specific property is in a contingency escrow to be sold on agreement between involved parties. 2. MaD of Property If a change or clarification is proposed in the Preferred Land Use Alternative, a map of the area proposed for the change is to accompany the application, and is to include enough of the surrounding area as is appropriate to adequately study the impact of the proposal. The size of the study area and scale of the map shall be determineo at the preapplication conference. An 8 1/2" x 11" transparency of the study area shall be provided. 3. PrODosed ~~~t.Ch~Qge If a change is proposed in the text of the Interim Policy Document, an exact wording proposal is to accompany the application. ODtional Data Any other data which might be helpful in understanding and evaluating the application. Other data required will be determined at the preapplication conference. C. PROCESSING Applications for Amendments to the Interim Document will be analyzed by Planning staff and report with recommendation prepared. Such applications will be considered by the Planning Commission at its second regular meeting every other month, beginning in July 1988 and including July, September and November of 1988, and January, March and May of 1989. The Planning Commission will make recommendations to the Mayor and Common Council. Policy a staff The recommendations of the Planning Commission will be considered by the Mayor and Common Council at their second regular meeting every other month, beginning in August 1988 and including August, OCtober, and December 1988, and February, April, and June 1989. Members of the General Plan Citizens Advisory Committee will be notified of the applications for Amendments to the Interim Policy Document to be considered by the Planning Commission and by the Mayor and Common Council. A cumulative listing of any amendments to the Interim policy Document approved by the Mayor and Common Council will be available within ten working days of the second Council meeting of the month. A request for Document which denied shall not General Plan. an amendment to the Interim Policy has been considered by the Council and be refiled prior to the adoption of the D.
