The matter was referred to Legislative Review for further consideration. On June 9, 1988, Legislative Review COmmittee considered the matter and the presentation of Mr. Steve Pleasant of C M Engineering. The Legislative Review Committee made the follow- ing findings: 1. The area is presently zoned R-1 Single Family Resi- dential. 2. The area is generally fully developed and not subject to further development. 3. The proposed division is for the current resident to construct a home for an immediate family member. 4. Economic considerations are considered to be valid in this instance. 5. The Municipal Code does allow a broad interpretation as to valid reasons for waiver. 6. It does not appear that the area will be undergrounded in the near future. The Committee, therefore, recommends to the Council that the requirement for undergrounding be waived on the project. The condition to complete street improvements, including curb and gutter, shall remain a condition of the parcel map. 6-10-88 75-0264 ~CIT~ OF SAN "R"~RDINO - R.QUBST PAl COUNCIL ACTION STAFF REPORT Tentative Parcel Map No. 10781 is to split a 16,400 sq. ft. single family lot from an existing 58,000 sq. ft. developed lot. This is an area that has been almost fully developed with single family residences on large lots. The conditions of approval, as approved by the Planning Commission, included the requirements that utility lines in ad- joining streets be undergrounded, and that curb and gutter be constructed along Circle Road. A letter appealing these condi- tions, dated 5-3-88, has been filed by Mr. Stephen L. Pleasant of C M Engineering Associates. . The letter from Steve Pleasant states that the esti- mated cost for undergrounding the existing utilities along Hillhurst Drive would be $64,800, and $40,800 along Circle Road. Our estimates are $89,435 along Hillhurst Drive and $25,890 along Circle Road. Section 18.44.070, Sub-Section N, of the Municipal Code, as amended by MC-601, adopted on 6-1-87, provides that a waiver may be submitted to the Mayor and Common Council. Waivers must be based upon the topographic conditions, soil or other factors that rend.r undergrounding unreasonable or impractical. There are some rather severe topographic conditions present at the site. However, undergrounding could be accom- plished at only a small increase in cost over flat land. The appeal is based principally upon the financial impact of this condition. It appears that the additional cost in excess of $100,000 would render this project unfeasible. Therefore, we recommend that a waiver be granted for the Hillhurst Drive frontage. This waiver would leave the requirement in place adjacent to the newly created lot, at an estimated cost of $25,890. Curb and gutter were required along the Circle Drive frontage, in order to control drainage and traffic. Also, the installation of curb and gutter will improve the appearance of the streetscape. The preliminary estimated cost for curb and gutter is $21,500. This was a requirement of the approval by the Planning Commission on April 19, 1988 for a 1.42 acre parcel split into 2 parcels consisting of a .95 acre and .37 acre parce 1. According to Mr. Bob Smith of Southern California Edison, the costs to underground existing overhead power1ines is estimated to be $120 per lineal foot. The costs to underground the power1ines along the adjacent streets would be around $105,600. Circle Road for approximately 340 feet would run $40,800 and Hi1lhurst Drive an additional $64,800. We feel that this cost burden is unrealistic with respect to an approval for a single additional home site. Also, it is not likely that there would be future development to underground the remaining lines nor because of the heavy vegetation are they obtrusive to the area. Additionally, we ask for the waiver of curb and gutter improvements along Circle Road. This is a semi rural area, drainage has not been a problem on this side of the street nor would the curb and gutter serve any useful purpose.
