CITY OF SAN BERNADINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
Bids for this project were opened at 2:00 p.m. Tuesday,
5-03-88.
A total of 3 bids were received, ranging from $24,400.00
o $24,900.00. The low bid of $24,400.00 is 9.6% under the Engi-
neer's Estimate of $27,000.00.
Listed below is an estimate of the total cost for pro-
viding these landscape maintenance services, from 7-01-88 to
6-30-89.

The Notice to Proceed will be effective on 7-01-88. The
contract will be in effect until 6-30-89, subject to two one-year
extensions by mutual consent.
Funds to cover the costs incurred will be upfronted by
the City, and reimbursed through special assessments placed on
the property tax bills, pursuant to the resolution establishing
the district.
The landscaping was installed by developers under their
conditions of approval. Maintenance is also being done by the
developers, until 7-01-88 when the Contractor will commence
work.
Supervision of the maintenance effort by the Contractor
will be provided by the Department of Parks and Recreation, who
have reviewed the bids and agree with awarding a contract.
We recommend that a contract be awarded to the low
bidder.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO CHEROKEE LANDSCAPE SERVICES FOR MAINTENANCE OF
LANDSCAPING IN PORTIONS OF PINE AVENUE, WALNUT AVENUE, OHIO
AVENUE, BELMONT AVENUE AND IRVINGTON AVENUE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Cherokee Landscape Services is the lowest
responsible bidder for: Maintenance of landscaping in portions
of Pine Avenue, Walnut Avenue, Ohio Avenue, Belmont Avenue and
Irvington Avenue, in accordance with Plan No. 7034-B (1988-89),
for the total amount of $24,400.00; a contract is awarded to
said bidder accordingly, but such award shall be effective only
upon the contract being fully executed by the parties; all other
bids therefor are hereby rejected; and the Mayor is hereby
authorized and directed to execute said contract on behalf of
the City; a copy of the contract is attached hereto, marked
Exhibit "A" and incorporated herein by reference as fully as
though set forth at length.
SECTION 2. Execution and Amendments. This contract and
any amendments or modifications thereto shall not take effect or
become operative until fully signed and executed by the parties
and no party shall be obligated hereunder until the time of such
full execution. No oral agreements, amendments, modifications or
waivers are intended or authorized and shall not be implied from
any act or course of conduct of any party.
