06-02-86 Res. No. 86-210 adopted awarding a contract to J & R Land-
scaping for Assessment District No. 956 for the low bid price
of $59,652.
06-01-87 Res. No. 87-177 adopted awarding a contract to Mentone Turf
Supply for Assessment District No. 968 for the low bid price
of $3,336.
06-01-87 Res. No. 87-178 adopted awarding a contract to J & R Land-
scaping for Assessment District No. 956 for the low bid
price of $64,417.

STAFF REPORT
Bids for this project were opened at 2:00 p.m. on 5-03-88.
A total of 4 bids were received, ranging from $59,996.00
to $110,000.00. The low bid of $59,996.00 is 17.8% under the
Engineer's Estimate of $73,000.00.
The bid documents were set up with Assessment District
No. 968 (Airport Drive) as Schedule I, and Assessment District
No. 956 (Tri-City) as Schedule II. This arrangement was used to
allow proper cost distribution to each district.
Listed below is an estimate of the total cost for pro-
viding these landscaping maintenance services, from 7-01-88 to
6-30-89, based upon the actual low bid price.

The Notice to Proceed will be effective on 7-01-88. The
contract will be in effect until 6-30-89, subject to two one-year
extensions by mutual consent.
Funds to cover the costs incurred will be upfronted by
the City, and reimbursed through special assessments placed on
the property tax bills, pursuant to the resolution establishing
the district.
Supervision of the maintenance effort by the Contractor
will be provided by the Department of Parks and Recreation, who
have reviewed the bids and agree with awarding a contract.
We recommend that a contract be awarded to the low
bidder.

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO CHEROKEE LANDSCAPE SERVICES FOR MAINTENANCE OF
3 LANDSCAPING IN PORTIONS OF AIRPORT DRIVE, VANDERBILT WAY,
HOSPITALITY LANE, CARNEGIE DRIVE, BRIER DRIVE, HARRIMAN PLACE,
4 WATERMAN AVE.NUE AND TIPPECANOE AVENUE.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Cherokee Landscape Services is the lowest
responsible bidder for: Maintenance of landscaping in portions
of Airport Drive, Vanderbilt Way, Hospitality Lane, Carnegie
Drive, Brier Drive, Harriman Place, Waterman Avenue and Tippecanoe
Avenue, in accordance with Plan Nos. 6244 and 6738-A, for the
total amount of $59,996.00, a contract is awarded to said bidder
accordingly, but such award shall be effective only upon the
contract being fully executed by the parties; all other bids
therefor are hereby rejected; and the Mayor is hereby authorized
and directed to execute said contract on behalf of the City; a

copy of the contract is attached hereto, marked Exhibit "A" and
17
incorporated herein by reference as fully as though set forth at
18
19
length.
SECTION 2. Execution and Amendments. This contract and
20
any amendments or modifications thereto shall not take effect or
21
become operative until fully signed and executed by the parties
22
and no party shall be obligated hereunder until the time of such
23
full execution.
No oral agreements, amendments, modifications or
24
waivers are intended or authorized and shall not be implied from
25
26
any act or course of conduct of any party.
I HEREBY CERTIFY that the foregoing resolution was duly

adopted by the Mayor and Common Council of the City of San
