Funding for the costs incurred on this project will be
provided pursuant to Resolution No. 81-482, adopted on October
5, 1981, and Resolution No. 81-235 adopted on 6-15-81, which
orders the installation and maintenance of the landscaping.
The landscaping was installed under previous contracts. Costs
for maintenance will be pre-funded by the City, as set forth
in the Resolution of Intention (No. 81-36), and the amount
reimbursed through aSsessments levied on all parcels within
the district for the following fiscal year.
Supervision of the maintenance effort by the contractor
will be provided by the Department of Parks, Recreation and
Community Services, who have reviewed the bids and agree to
awarding a contract.
We recommend that a contract be awarded to the low
bidder.

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO CHEROKEE LANDSCAPE SERVICES FOR MAINTENANCE OF
3 LANDSCAPING IN PORTIONS OF KENDALL DRIVE (STATE ROUTE 206);
AND UNIVERSITY PARKWAY, COLLEGE AVENUE, 48TH STREET, KENDALL
4 DRIVE (STATE ROUTE 206), NORTHPARK BOULEVARD AND LITTLE MOUNTAIN
DRIVE.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
6 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Cherokee Landscape Services is the lowest
8 responsible bidder for construction of a public project. to-wit:
9 Maintenance of Landscaping in portions of Kendalr Drive (State
10 Route 206), Assessment District No. 951, in accordance with
11 Plan No. 6192-A (1988-89), and in portions of University Parkway,
12 College Avenue. 48th Street, Kendall Drive (State Route 206),
13 Northpark Boulevard and Little Mountain Drive, Assessment
14 District No. 952, in accordance with Plan No. 6056-A (1988-89)
15 for the total amount of $41,623.00. a contract is awarded to
16 said bidder accordingly, but such award shall be effective only
17 upon the contract being fully executed by the parties; all other
18 bids therefor are hereby rejected; and the Mayor is hereby
19 authorized and directed to execute said contract on behalf of
20 the City; a copy of the contract is attached hereto, marked
21 Exhibit "A" and incorporated herein by reference as fully as
22 though set forth at length.

SECTION 2. This contract and any amendments or
24 modifications thereto shall not take effect or become operative
25 until fully signed and executed by the parties and no party
26 shall be obligated hereunder until the time of such full
27 execution. No oral agreements, amendments, modifications or
28 waivers are intended or authorized and shall not be implied from
