DESCRIPTION) Flnence: Council Note.: Aqenda Item No._ ~O 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 o o RESOLUTION No. RESOLUTION OF THE CITY OF SAN BERNARDINO SUPPORTING PROPOSED LEGISLATION FOR CONGRESSIONAL AUTHORIZATION TO LINE PORTIONS OF THE ALL AMERICAN CANAL AND THE COACHELLA BRANCH WHEREAS, a significant amount of Colorado River water is now lost in the process of delivering a major portion of California's apportionment through the All American Canal and Coachella Branch, and; W'rlEREAS, these canals, were originally constructed as unlined earthen facilities, and have remained unlined for over 40 years, and; WHEREAS, lining the canals will make better use of California's 4.4 million acre-foot annual apportionment of Colorado River water, and; WHEREAS, the U.S. Bureau of Reclamation has estimated that it is cost- effective to line portions of the unlined sections of the All American Canal and Coachella Branch, and; WHEREAS, the Secretary of the Interior holds title to the All American Canal and Coachella Branch. NOW, THEREFORE, BE IT RESOLVED THAT THE MAYOR AND COUNCIL OF THE CUY Of SAN I\F,RNARDINO supports Congressional legislation authorizing the Secretary of the Interior to line the All American Canal between Pilot Knob and Drop 4, and the Coachella Branch between Siphon 7 and Siphon 32. IK THE HOUSE OF REPRESENTATIVES FEBRUARY 23, 1988 Mr, LE\"ISE of California (for himself, Mr, MCCAI'lDLESS, Mr. GALLEGL1", and Mr, MILLER of California) introduced the following bill; which was referred to the Committee on Interior and Insular Affairs A BILL To authorize the Secretary of the Interior to proyide water conserntion opportunities b~' lining the All.American Canal, Boulder Canyon Project, and for other purposes. 1 Be it enacted by the Senate and House of Representa- 2 tives of the United States of America in Congress assembled, 3 SECTION I. AUTHORIZATION OF PROJECT. 4 (a) IN GENERAL'-In order to provide for water conser- 5 vation and other purposfs, the SecretaI')' is authorized- 6 (1) to construct a new lined canal or to line the 7 presently unlined portions of the All-American Canal 8 of the Boulder Can)'on Project from the vicinity of 9 Pilot Knob to'Drop 4 and its Coachella Branch from , . o o 2 1 Siphon 7 to Siphon 32, including measures to protect 2 public safety; and 3 (2) to implement measures to replace incidental 4 fish and "ildlife values foregone. 5 The Secretary may contract with participating contractors 6 for the construction and funding of all or any part of the j project. 8 (b) AVAILABILITY OF WATER.- 9 (1) The water conserved by the project shall be 10 made available for beneficial consumptive use within 11 the State of California. The types and places of such 12 uses by the participating contractors shall be the same 13 as those specified in their existing water delivery con- 14 tracts "ith the Secretary. 15 (2) The contracts for funding shall entitle the par- 16 ticipating contractors to a proportionate share of the 17 water conserved on a calendar ~'ear basis expressed in 18 terms of a percentage of the funds contributed pursuant 19 to section 2. This quantity of water shall be in addition 20 to the quantit~. of water available to the participating 21 contractors lunder their existing contracts "ith the Sec- 22 retary, absent the lining projects, but shall be consid- 23 ered as part of California's Colorado River apportion- 24 ment. eliI-; :{!t,..~ Hl o o 3 1 (c) CANAL OPERATIONs.-The Secretary' shall stud~' 2 the impact of the project on the operation and maintenance of 3 the existing All-American Canal and its Coachella Branch. H 4 the study demonstrates that there are added costs of oper- 5 ation and maintenance which exceed the benefits to the 1m- 6 perial Irrigation District or the Coachella V ~ley Water Dis- 7 trict as a result of the project, the Secretary.shall include the I 8 findings of his study and construction of necessary facilities in 9 his plan for the project. Such added costs shall be included in 10 the costs of the project pro,;ded for in section 2(b). 11 SEC. 2. PAYMENT OF COSTS. 12 (a) CONSTRUCTION SUBJECT TO AVAILABILITY OF 13 FUl'Ws.-The Secretary shall not begin construction of the 14 project until funds are available pursuant to the pro,;sions of 15 this section. 16 (b) AVAILABILITY OF FuNDs.-The contracts for fund- Ii ing shall pro,;de that the cost of the project shall be paid 18 from funds advanced by the participating contractors under 19 the authorit:y of the Contributed Funds Act of March 4, 1921 20 (41 Stat. 1401), the Reclamation Act of 1902 (32 Stat. 388), 21 and Acts amendatory thereof or supplementar~' thereto, and 22 in accordance ,,;th tenns and conditions acceptable to the 23 Secretary. 24 (c) TITLE TO FACILITIES CONSTRtTCTED.-By virtue 25 of their financial participation in these projects, a participat- em.: 3!':o." DEFI!<lITIONS. 9 For the purposes of this Act- IO (1) the tenn "participating contractor" means the 11 Metropolitan Water District of Southern California and 12 any other California agency who- 13 (A) is a signatory to the Seven Party Agree- 14 ment of August 18, 1931, 15 (B) is a contractor for delivery of Colorado 16 River water pursuant to section 5 of the Boulder 1 i Canyon Project Act (45 Stat. 1057), and 18 (C) elects to participate in the project de- 19 scribed in section 1; 20 (2) the tenn "project" means the project author- 21 ized under section 1(a) of this Act; and , 22 (3) the term "Secretary" means the Secretary of 23 the Interior, o ellp. ,."
