STAFF REPORT
The Water Department had a 20" riveted steel water transmis-
sion main from the ~ntil Pumping Plant to Baseline Street and
Waterman Avenue. The pipeline was installed on a northwest
diagonal from Antil to Baseline and Waterman Avenue in 1915.
To accomplish this installation, right-of-ways were acquired
from all of the affected property owners. One parcel affect-
ed by this right-of-way route is Lot 13, Block 43, Rancho San
Bernardino. The Water Department paid to acquire this right-
of-way. In subsequent years, the riveted steel pipeline was
abandoned by the Water Department when a new main was in-
stalled from Waterman to Bobbitt Drive and on Bobbitt Drive
down to the Antil Plant (Map Attached) ."

The Board of Water Commissioners, at their regular meeting
held AprilS, 1988, unanimously voted to approve quitclaiming
the right-of-way back to Frank and Margaret Kopman for a fee
of $150.00, and authorized the Secretary to submit the
request for Quitclaim to the Mayor and Common Council for
approval.

RE: Abandonment right-of-way for water pipe
This is a matter or urgency which should be placed
on the Supplemental Agenda because the quitclaim deed must
be executed in order to close escrow. Escrow agent is First
American Title; sellers are Frank and Margaret Kauffman. This
item should be put on the Supplemental Agenda to meet the
deadline of the outside title company.
Significant financial complications may occur if this is not
placed on the Supplemental Agenda of the 5/2/88 Council meeting.

RESOLUTION NO.
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AUTHORIZING THE QUITCLAIMING OF A RIGHT-OF-WAY TO
FRANK AND MARGARET KOPMAN OVER A PORTION OF LOT l3, BLOCK 43,
RANCHO SAN BERNARDINO.
WHEREAS, the City of San Bernardino acquired a right-of-way
on April 16, 1915, for the construction, maintenance, repair and
operation of a pipeline; and
WHEREAS, the Water Department installed and maintained a
twenty (20) inch riveted steel water transmission pipeline
within said right-of-way; and
WHEREAS, the Water Department abandoned the pipeline and no
longer has a need for the right-of-way.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
That the right-of-way acquired from J.S. Beam on April 16,
19l5 be quitclaimed to the current owners of the property, Frank
and Margaret Kopman, Husband and Wife as joint tenants for a fee
of $lSO.OO.
SECTION 2.
That the Mayor be authorized to execute the Quitclaim Deed
23 for the City of San Bernardino, a copy of which is attached
24 here,to, marked Exhibit "A" and incorporated herein as though set
25 forth at length.
