No. 9,between 3rd Street and 5th Street and between Arrowhead Avenue
and Sierra Way.
04/04/88 -- Resolution No. 88-102 adopted for Undergound Utility District No. 13,
which contained as assessment for the assessment roll for Undergound
Utility District No.9.
Recommended motion:
1. That the hearing to hear protests on the proposed assessment for conversion of
electrical services within the Government Center area Underground Utility
District No.9, be closed
2. Adopt Resolution

STAFF REPORT
The Government Center are3Underground Utility District No.9, was established by
Resolution No. 83-361, adopted on November 7, 1983, as authorized under Chapter
13.36, .Underground Utilities", of the San Bernardino Municipal Code. This
resolution stated that the undergrounding was to be completed by May 1, 1984.
Edison had conduits and vaults installed to replace their aerial facilities. This
work included stubbing out a conduit to each parcel. Each property owner is
responsible for conversion of the electrical service from aerial to underground,
and extending a conduit to join the one stubbed out by Edison.
property owners within the district were notified by the following transmittals,
as provided in Sub-section 13.36.090, of the need to convert their services:
. 1. Letter dated October 18, 1983, with copy of Resolution No. 83-333,
giving notice of the public hearing.
2. Letter dated June 20, 1985, giving notice to convert by July 21,
1986.
Copies of these letters are attached for reference.
The majority of the property owners had the work done. However, it was necessary
for the City to have the work accomplished for those parcels which owners had
failed to do.
On April 4, 1988, Resolution No. 88-102 was adopted, confirming the assessment
roll for Underground Utility District No. 13. Assessment No. 32 of that roll, was
not actually in that district and should have gone on assessment roll for
Underground Utility District No.9, which is hereby attached as Exhibit '''A'' of
the attached resolution.
We recommend that the hearing be closed and the assessments confirmed.

A public hearing has been scheduled by the Mayor and Common Council
to determine whether the public necessity, health, safety or welfare
requires the formation of Underground Utility District No.9. This
public hearing will be held before the Mayor and Common Council on
November 7, 1983, at 9:00 a.m., in the Council Chambers of City Hall
at 300 North "0" Street. All persons that so desire will be afforded
an opportunity at this hearing to express their views on the proposed
UndergroundUtil ity Disti'ict.
The boundaries of the proposed Underground Utility District No.9 are:
Between Arrowhead Avenue and Sierra Way and between Third
Street and Fifth Street and Sierra. Way and a point 545 ft.
south of Third Street.
The Mayor and Common Council will determine at this public hearing if
Underground Utility District No.9 is required. If it is determined
that the district is required, a resolution will be adopted to declare
the designated area Underground Utility District No.9.
. Enclosed is a copy of Resolution 83-333 (giving notice of the public
hearing) and a map showing the boundaries of Underground Util ity Dis-
trict No.9. If you desire any further information on the proposed
district, please contact the City Engineering Division at 383-5111.

Dear Sir:
Notice is hereby 9iven that pursuant to San Bernardino
Municipal Code, Section 13.36,090, and action of the Mayor and
Common Council of the City of San Bernardino, you are hereby
notified that you must construct or cause to be constructed
certain improvements to that portion of your property known as
Assessor's Parcel No. 0135-181-29 which fronts on Sierra Way in
the following manner. to-wit:
All overhead utl1ity facl1ities within Underground
Utility District No.9 (electrical, telephone, TV
cable) will be taken out of service by July 21,
1986. Each property owner will be responsible for
placi ng these utl1 i ty facl1 i ties underground, from
t~e property li ne to the servi ce poi nt for all
existing structures.
The construction shall be in compliance with existing City
Standard Drawings, a copy of which is enclosed, and must be
installed utl1izing the materials as stated thereon. The con-
struction must be completed before July 21, 1986, which is30
days from the date of this notice. Ne.cessary permits may be
obtained at the office of the City Engineer, City Hall, San
Bernardino.

If the construction is not completed by you or your contractor
by the above date, the Director of Public Works/City Engineer',
_ _bY._Clrder of the Mayor, may cause the construction to be done
and the cost therefor, together with incidental costs, will be
assessed against the property and such assessment will become a
lien on the prop.erty. You will be notified of when the costs
will be confirmed by the Mayor and Com.on Council and you will
have 5 days thereafter in which to pay the costs to the City,
otherwise the costs will be collected.
An opportunity to be heard on such assessments will be afforded
you after completion of the work.
If you desire any further information pertaining to the matter,
please contact the City Engineering Division at 383-5111.

A RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE ASSESSMENT
2 ROLL FOR UNOERGROUND UTILITY DISTRICT NO. 9 GENERALLY LOCATED BETWEEN 3RD
STREET AND FIFTH STREET AND BETWEEN ARROWHEAD AVENUE AND SIERRA WAY.

WHEREAS, pursuant to the provisions of Chapter 13.36 of the San
Bernardino Municipal Code. the Mayor and Common Council of the City of San
Bernardino did adopt Resolution No. 83-361 on the 8th day of November. 1983,

Street and 5th Street and between Arrowhead Avenue and Sierra Way, and
ordered the construction of underground facilities by owners of certain
properties within said Undergound Utility District No.9, which said
construction was to be completed by May I, 1984, and which date was extended
to July 21. 1986.
WHEREAS. the said construction was not completed by said date and the
Director of Public Works/City Engineer caused said work to be done.
WHEREAS. an assessment roll has been prepared. totaling $725.00, which
sets forth the individual assessments to be levied on each of the parcels of
land lying within said Underground Utility District No.9.
18 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
19 CITY OF SAN BERNARDINO AS FOLLOWS:
20 SECTION 1. That the Mayor and Common Council do hereby find and
21 determine that the costs to be levied against the parcels of land lying
22 within Underground Utility District No.9, designated as Exhibit "A" and
23 incorporated herein by reference, are correctly set forth and do hereby
24 confirm said assessments,
25 SECTION 2. The the City of San Bernardino. acting through it's
26 Director of Public Works/City Engineer, does hereby claim a lien on all of
27 the properties listed in said assessment roll in the amounts so listed which
28 are not paid within five (5) days from the date of this Resolution

and the same shall be a lien upon said real property and collected with the
property taxes. The assessment shall be due and payable at the same time as
the property taxes are due and payable, and if not paid when due and
payable, shall bear interest at the ra.te of six (6) percent per year.
SECTION 3. That pursuant to Chapter 13.36 of the San Bernardino
Municipal Code, the Director of Public Works/City Engineer is directed to
cause a copy of this Resolution and a list of the unpaid assessments to be
transmitted to the office of the Auditor-Controller for the County of San
Bernardino with the request that the individual assessments be placed on the
subject property tax bills for collection together with all other property
taxes.
