Vote: Unanimous. Recommended motion: Adopt the Negative Declaration, and Approve the findings and the recommendation of the Planning Commission and direct the City Attorney to prepare the necessary amendments to the Zoning Code. PROPOSED ~~~DMENT The proposal is to amend Section 19.60.100 Bernardino Municipal Code to place greater on the use of temporary signs for business City. MllliJCn'~L CODE Presently Section 19.60.100 of the San Bernardino Municipal Code permits ....for periods not exceed three months for banners, six months for flags, and twelve months for pennant, and maintained in good repair.. 3 . ~QA STATUS At their regularly scheduled meeting of March 24, 1988, the Environmental Review Committee recommended a negative declaration. The public review period for the initial study began April 1, 1988 and ended April 13, 1988. No comments were received. 4 . BACKGB.Q!JIUl On January 26, 1988, the Planning commission adopted Resolution 87-9 initiating an amendment to the Municipal code to limit the use of banners to two (2) forty-five (45) day periods per year and to limit the size of any banner to fifty (50) square feet. M~M,xall The present ordinance does not really place control on the number of times per year that a business can use temporary signs. It is a common practice for ~ business to get back to back permits which would then allow banners, pennants and flags year round. o o The Planning Commission Re: At 87-9 Apr il 19, 1988 The proposed amendment would place definite time frames that a business would be allowed to use such signs on an annual basis with separation of time between permits. As evident in the proposal (Exhibit "B") such temporary signage will be granted a maximum of twice per year for a maximum time of 45 days each time with a minimum of 60 days between each permit. In addition, the size of such signs are restricted maximum area of ten percent of the wall area. Not than ~ banners shall be on display during permitted time period and the maximum size for any banner shall be no greater than 50 square feet. With the ordinance amendment a benefit will be made in that a less cluttered appearance will be present in parking lots and landscaped areas throughout the City, thereby improving the image of the City. to a more the one 6. COMMENT~~E~m During the review period of the initial study which followed the Environmental Review committee, no comments were received from the public at large. The Chamber of Commerce was provided a copy for their review with no comment received at the time of this writing. 7. CONCLU~JP~ The proposed ordinance amendment was initiated by the City at the request of the Mayor's Office to limit the time and number of times per year that a business may utilize such signs. No comments in favor or disfavor of the ordinance amendment was received from the public or business community. "A. Banners, flags and pennants shall be allowed with a permit from the Department of Building and Safety in C-l, C-2, C-3, C-3A, C-4, C-M, M-l, M-lA and M-2 zones for periods not to exceed three months for banners, six months for flags, and twelve months for pennants, and maintained in good repair. Temporary window signs may be permitted on the inside of window facing out which do not cover more than 50% of the individual window surface for a period not to exceed ninety days using during any twelve month period." ORDINANCE: OF' THE CITY OF SAN BERNARDINO AMENDING SECTION 19.60.100 SUBSECTIONS A AND B OF THE SAN BERNARDINO MUNICIPAL CODE REGARDING TEMPORARY SIGNS. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. Section 19.60.100 Subsections A and B of the San Bernardino Municipal Code is amended to read as follows: "19.60.100 Temporary signs. A. Banners, flags and pennants shall be allowed with a permit from the Department of Building and Safety in C-l, C-2, C- 3, C-3A C-4, C-M, M-l, M-lA and M-2 zones for periods not to exceed forty-five days. Such temporary sign permits shall not be granted to the business or location more than twice during any one year. The two permitted time periods shall not be granted consecutively, but shall be separated by a time period of at least sixty days. Banners shall not occupy more than ten percent of the wall area exclusive of window or door area upon which the sign is 19 located. A maximum of two banners shall be permitted in anyone 20 time period. The maximum size for anyone banner shall be fifty 21 square feet. 22 B.
