CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: Resolution awarding contract to Lambco Engineering, Inc. for storm drain outlet structure repair on 40th Street, Phase I, per Plan No. 10320. Background: This project consists of the repair and installation of rip-rap at the 401h Street storm drain outlet structure east of "H" Street. Rip-Rap is the loose rock placed in front of the outlet structures to prevent erosion. This structure which has been damaged and eroded due to the effect of previous storms and is currently in need of immediate repair prior to the next heavy storm. Staff is proposing to move forward with the Phase I repair as soon as possible to prevent further damage to the outlet structure. Due to time constraints, the complete reconstruction and repair can not be done during the rainy season; Phase II of this project will be completed after the rainy season. Plan and specifications for this project are complete and the project is ready to be awarded. The estimated project costs are as follows: Construction Cost $28,900.00 Contingencies $5,000.00 Design (Phase I & II), Inspection, and Contract $16,100.00 Administration Total $50,000.00 This project was advertised locally in the San Bernardino County Sun Newspaper, Construction Trend Newspaper, the City's web site, and with the San Bernardino Area Chamber of Commerce. Fall Brook $43,000.00 Engineering Estimate $30,000.00 Based on a review of the sealed competitive bids received, staff has determined that Lambco Engineering, Inc., the apparent lowest bidder, has met the minimum requirements of the specifications and bid guidelines, and therefore recommends that the Mayor and Common Council award the referenced contract accordingly. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 3 BERNARDINO AWARDING A CONTRACT TO LAMBCO ENGINEERING, INC. 4 FOR STORM DRAIN OUTLET STRUCTURE REPAIR ON 40TH STREET PHASE I, PER PLAN NO. 10320. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 6 CITY OF SAN BERNARDINO AS FOLLOWS: 7 SECTION 1. Lambco Engineering, Inc, is the lowest responsible bidder for. storm 11 but such award shall be effective only upon being fully executed by both parties. All other 12 bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute 13 said contract on behalf of the City; a copy of the contract is on file in the office of the City 14 Clerk and incorporated herein by reference as fully as though set forth at length. 15 16 17 18 19 SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or 20 21 course of conduct of any party. 22 SECTION 3.
