I IJ jlqjlJ) Agenda Item No. /1 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subiect: Authorization for the Director of Finance to amend FY 2001/02 budget and authorization to execute Change Order No. One to contract with Anthony Marmolejo Construction Company, Inc. for modifications to the Seccombe Lake Activity Center to meet Americans with Disabilities Act Standards (ADA) per revision nos. 1 and 2 of plan no. 10214. Backl:round: The Parks and Recreation Department requested that the Public Works Division administer the design and construction of the subject project which consists of removal and reinstallation of partition walls, toilets, and sinks in the men and women's restrooms, and modification to the path of travel from the parking lot to the Parks and Recreation Department's main office aIlIlex building at 555 North Sierra Way. These modifications are necessary in order to meet Americans with Disabilities Act (ADA) requirements. Bids were received and a contract in the amount of $70,528.00 was awarded to Anthony Marmolejo Construction Company, Inc. on May 21,2001. Upon start of construction, it became apparent that certain changes to the plans were needed to assure a safe and fully functional project. Please see the attached Change Order No. One for details of the changes. These project changes will also result in increased inspection costs related to the change order work. Therefore, we are recommending that a total of $19,000.00 be transferred from account no. 243-000-3405 (Unappropriated Park Construction Fund) to cover the cost of this change order and the additional inspection costs. Financial Impact: To cover the cost of this change order and the cost of increased inspection, staff is requesting that the Director of Finance be authorized to amend the FY 2001/2002 budget increasing the budget in Account No. 243-363-5504-7107 by $19,000.00 and reflect the associated reduction in Account No. 243-000-3405 (Unappropriated Park Construction Fund). Recommendation: 1. ONE FILE NO, 6.14-7107 DATE: OCTOBER 23, 2001 PROJECT: MODIFICATIONS TO PROVIDE DISABILITY ACCESS AT THE SECCOMBE LAKE ACTIVITY CENTER LOCATED AT THE PARKS & RECREATION DEPARTMENT MAIN OFFICE ANNEX AT 555 N. SIERRA WAY PER PLAN NO 10214. TO: Anthony Marmolejo Construction Company inc. 952 E. Ramsey Street, Suite B Banning, CA 92220 GENTLEMEN: You are hereby compensated for performing the additional work as follows: Description of Chanl!e Cost Move new ADA entry from north side of building to west side of building near the northwest corner, construct a "Storefront" over the new entry, construct handicap accessible ramp at new entry to building and modify $13,561.93 interior walls to conform to new entry arrangement per revision nos, 1 and 2 of plan no. 10214. JUSTIFICATION: Upon start of construction, it was discovered that the proposed new entry on the north side of the building could not be made handicap accessible because the existing building floor was approximately 8 inches below the adjacent outside ground. Cutting a handicap accessible entry through the north wall could have resulted in drainage water flowing into the building from rainfall and from landscape irrigation. There was no readily available method of conveying the water away from the building at the designed entry location. To correct the problem, the Architect revised the plans by moving the handicap accessible entrance to the west side of the building near the northwest corner. In addition, a covered entry (storefront) was designed to shield the new entry from the westerly sun and to prevent water from entering the building during rainstorms. In order to make the new entry handicap accessible it was necessary to install a sloping ramp from the new entry to a location 26' 8" Contract Change Order No. One Modifications To Provide Disability Access At The Seccombe Lake Activity Center. Page 2 of2 into the building and to modify interior walls to fit the ramp. The Architect worked closely with City staff and performed the design changes at no additional cost to the City. The new ramp and related interior remodeling resulted in additional costs to the Contractor. After some negotiation between the Contractor and City staff, an amount of $13,561.93 was agreed to be a fair and reasonable price for the extra work involved in the change order. Attached is a copy of the final proposed cost of the change order as submitted by Anthony Marmolejo Construction Company, Inc. Details of this Change Order were reviewed and approved by John Kramer, Acting Director of the Parks and Recreation Department prior to proceeding with the work.
