Background: This project consists of the removal and reconstruction of the street section on Commercial Road between Hunts Lane and Waterman A venue. This section of road experiences significant truck traffic, and the original pavement section has deteriorated due to inadequate design to meet the loads. It is currently in very poor condition, which is why staff is proposing to move forward with this project even without placing the fmal lift (1 "-Ph") of pavement upon request from the City of Riverside. The City of Riverside has requested consideration from the City regarding the proposed installation of a master plan water line. Consequently, staff has agreed to defer the fmallift of pavement in this project until after completion of their storm drain project if they will agree to fund 50 percent of that fmallift (see attached letter). Riverside has committed to completing their water line within 18 months or less. Staff will verify Riverside's participation in writing prior to issuing a Notice to Proceed on this project. Plan and specifications for this project are complete and it is ready to be awarded. The estimated project costs are as follows: Construction Cost $260,952.90 Continl!encies $ 39,047.10 Design, Inspection, and Contract Administration $ 30,000.00 Total $330,000.00 This project was advertised locally in the San Bernardino County Sun Newspaper, Construction Trend Newspaper, the City's web site, and with the San Bernardino Area Chamber of Commerce; the following companies responded: Name of Bidder City Amount of Bid Enllineer's Estimate $302.624.00 CDE Resources San Bernardino $260,952.90 Holland-Lowe Construction, Inc. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO CDE RESOURCES, INC. FOR PAVEMENT REHABILITATION ON COMMERCIAL ROAD FROM HUNTS LANE TO WATERMAN A VENUE PER PLAN NO. 10251. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. CDE Resources is the lowest responsible bidder for pavement rehabilitation on Commercial Road from Hunts Lane to Waterman Avenue. A contract is awarded accordingly to said bidder in a total amount of $260,952.90, with a contingency amount of $39,047.10, but such award shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. In return the City of San Bernardino will pennit the installation of your master plan waterline in this portion of Commercial Road, and defer the final lift of pavement until such time as the waterline is installed.
