Subiect:
Resolution authorizing the Mayor or her designee to execute Program Supplement Agreement
with the Railroad at grade crossing and signal improvement at Palm Avenue and BNSF track.
Backl!round:
On May 20, 1997 the City of San Bernardino entered into an "Administering Agency - State
Agreement" (Master Agreement) with the State of California Department of Transportation for
Federal Aid projects. The Development Services Department is aggressively pursuing State
and Federal funds for associated transportation projects.
The Master Agreement has no force or effect with respect to any Program project unless and
until a project-specific, Program Supplement to the Agreement (Agreement) has been executed.
Each project Agreement designates the State and City responsibilities for implementing the
various phases of the project, i.e., right-of-way, preliminary engineering, construction, and
construction engineering. The Program Supplement Agreement for these improvements
includes construction and construction engineering phases of the project.
The State requires a copy of an approved Resolution authorizing a designee to execute a
Program Supplement Agreement with the State for Federal Aid projects.
Financial Impact:
There is no financial impact.
Recommendation:
Adopt Resolution.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BER.I'olARDINO AUTHORIZING THE MAYOR OR HER DESIGNEE TO
EXECUTE PROGRAM SUPPLEMENT AGREEMENT NO. 005-M WITH THE STATE
OF CALIFORNIA FOR RAILROAD AT GRADE CROSSING AND SIGNAL
IMPROVEMENT AT PALM AVENUE AND BURLINGTON NORTHERN SANTA FE
TRACK (BNSF).
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
WHEREAS, before Federal-aid will be made available for a specific project, the City
is required to enter into agreements with the State relative to prosecution, administration,
special provisions and maintenance of Project facilities.
WHEREAS, before Federal-aid will be made available, other agreements related to
Federal-aid requirements may be required.
WHEREAS, the City Council approves each project and allocated funding with the
Capital Improvement Program budget each year.
NOW, THEREFORE, BE IT RESOLVED that the Mayor or her designee be
authorized to execute Program Supplement Agreement No. 005-M (attached as Exhibit A) for
19 railroad at grade crossing and signal improvement at Palm Avenue and Burlington Northern

This Program Supplement is hereby incOlporated into the Agency-Slate Agreement for Federal Aid which was entered into between
the Agency and the Slate on OS/20/97 and is subject to all the tenus and conditions thereof. This Program Supplement is adopted in
accordance with Article I of the aforementioned Master Agreement under authority of Resolution No.
approved by the Agency on (See copy attached).

SPECIAL COVENANTS OR REMARKS
1. All required pavement marking and advance warning signs shall
comfor.m to the requirements of MUTCD, 1988 and shall be placed in
their proper location by the Local Agency at the time of
completion of the Railroad's work.
2. Federal funding levels are shown for information only.
Federal and Local funds shall be paid to the railroad or
contractor by the State according to the terms described in the
Service Contract between the railroad or contractor and the
state.
The Local Agency share of funding shall be due and payable upon
receipt by the State of an approved invoice from the Railroad.

3. The cost of maintenance of the crossing shall be as allocated by
Public Utilities Commission.

adopted Resolution 2001-302 - Resolution authorizing the Mayor or her designee to execute
Program Supplement Agreement with the Railroad at grade crossing and signal improvement at
Palm Avenue and BNSF track.
Attached is one original agreement (Program Supplement No. MOOS). Please obtain signatures
in the appropriate locations and return the original agreement to the City Clerk's Office as soon
as possible, to my attention.
