Backl!round: The Public Works Division received a petition from cll1zens requesting the closure of Pennsylvania Avenue south of 19th Street. The requestors are residents of the area of Pennsylvania Avenue between 16th Street and 19th Street. They feel that non-resident traffic is a public nuisance, a danger to human life/property and interferes with the enjoyment of life for the residents and family members. They feel that if Pennsylvania Avenue south of 19th Street were closed, these issues would be resolved. Traffic Engineering Staff completed a preliminary evaluation of the complaint. If the closure of Pennsylvania Avenue is approved, traffic will be diverted to Flores Street and Pennsylvania Avenue north of l6h Street. This is not expected to cause a major traffic impact to these streets, however, the overall effect will be further evaluated in the formal study. The requested closure will be evaluated in accordance with the City's Policy on Closure of City Streets. The policy requires that the proponents of the closure, in two equal payments, pay a $ 1,000 administrative fee. One payment before the formal study is initiated and the other after the formal study is completed but before the report is submitted to the Mayor And Common Council for consideration. The residents who initiated the request are asking that the administrative fee be waived. They claim that the administrative fee will pose a financial burden to the working families of this area (see attached request for waiver). With this action, staff will proceed to the next step in the process, which will include preparing and circulating a petition to residents in the area affected by this closure. Financial Impact: If the Mayor and Common Council agree to waive the fee, the City will not realize the $1,000 fee revenue. Recommendation: That in accordance with the City's Policy on Closure of City Streets, the Public Works Division be authorized to proceed with study relative to the request to close Pennsylvania Avenue south of 19th Street and that the $ 1,000 Administrative fee required to initiate this study be waived. The non-resident traffic is a public nuisance, a danger to human life and property and it interferes with the enjoyment oflife for the residents and their family members. The administrative fee poses a financial burden to the working families of this area. Therefore, a waiver of the required fees for the formal traffic study is requested.
