Currently, violations of San Bernardino Municipal Code Chapter 8.24 are designated as
misdemeanors pursuant to Section 8.24.280. Chapter 8.24 includes violations for illegal
dumping, burning garbage, disposal of whole tires, hauling garbage without a permit, and
placement of refuse containers. The amendment changes the designation of violations of Section
8.24.210(B), placement of containers and bins, from a misdemeanor to an infraction. This
amendment makes the penalty for this violation more consistent with other violations in the San
Bernardino Municipal Code in regard to the level of gravity of the offense.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:
6 SECTION I. Section 8.24.280 is hereby amended in the San Bernardino Municipal Code
to read as follows:

Section 8.24.280
Violation - Penalty.

Any person, firm or corporation violating any provision of this Chapter, with the
9 exception of Section 8.24.21 O(B), is guilty of a misdemeanor, which upon conviction thereof is
punishable in accordance with the provisions of Section 1.12.010.
