Background: Patrons of the new Cinema Star Theater Complex are permitted to park within the parking structure of the Carousel MaiL The parking structure is located on the south side of 4th Street between "F" Street and "E" Street An opening to the parking area was constructed on 4th Street between "F" Street and "E" Street directly across from the entrance to the theater to allow pedestrians more direct access to the theater complex. This has resulted in a number of pedestrians crossing the street at the mid-block point, thereby creating a potentially unsafe condition for themselves and motorists travelling this section of 4th Street To resolve this situation, the Mayor and Common Council directed that a signalized pedestrian-controlled crossing be installed at this location. This crossing would assign right -of- way to pedestrian traffic while causing a minimum delay to motorists. Installation of this pedestrian crossing will not commence until after the Route 66 Rendezvous@. Plan and specifications for this project are complete; the work is ready to be awarded. The estimated project costs are as follows: Construction Cost $54,495.00 Contingencies $ 8,200.00 Design, InsDection, and Contract Administration $ 8,305.00 Total $71,000.00 This project was advertised locally in the San Bernardino County Sun Newspaper, Construction Trend Newspaper, the City's web site, and with the San Bernardino Area Chamber of Commerce; the following companies responded: Name of Bidder . RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO STEINY AND COMPANY, INC. FOR INSTALLATION OF A SIGNALIZED PEDESTRIAN CROSSING ON 4TH STREET BETWEEN "F" STREET AND "E" STREET PER PLAN NO. 10059. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Steiny and Company, Inc. is the lowest responsible bidder for installation of a signalized pedestrian crossing on 4th Street between "F" Street and "E" Street. A contract is awarded accordingly to said bidder in a total amount of $54,495.00, with a contingency amount of $8,200.00, but such award shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3.
