Dept: Development Services MCC Date: July 9, 2001 Synopsis of Previous Council Action: 3/27/01 Council approved pavement rehabilitation projects, directed the Public Works Division to proceed with design and bid document preparation, authorized the Director of Finance to amend the FY 2000-2001 Capital Projects Budget and appropriate $500,000 from the undesignated AB2928 Traffic Congestion Relief fund balance for Citywide Pavement Rehabilitation projects. STAFF REPORT CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Subject: Resolution awarding contract to All American Asphalt Corporation for pavement rehabilitation on 6th Street from "E" Street to Arrowhead Avenue Background: Assembly Bill AB 2928 Traffic Congestion Relief Plan provides funding to cities and counties for street and highway pavement maintenance, rehabilitation and reconstruction. The Council approved the associated list of projects on March 27, 2001, which included the pavement rehabilitation on 6th Street from "E" Street to Arrowhead Avenue. Plan and specifications for this project are complete and it is ready to be awarded. The estimated project costs are as follows: Construction Cost $ 97,182.85 Contingencies $ 14,774.43 Design, Inspection, and Contract Administration $ 14,774.43 Total $126,731.71 This project was advertised locally in the San Bernardino County Sun Newspaper, Construction Trend Newspaper. the City's web site, and with the San Bernardino Area Chamber of Commerce; the following companies responded: Name of Bidder City Amount of Bid All American Asphalt Corporation Corona $ 97,182.85 Holland-Lowe Construction, Inc. San Bernardino $101,860.20 Coolev Construction, Inc. Victorville $108,297.90 Pyramid Building & Construction Hesperia $111,323.40 Financial Impact: Funding for these projects in the amount of $1,328,273 has been allocated from the State's AB 2928 Traffic Congestion Relief Plan and made available for FY 2000/2001 & 2001/2002. All costs incurred will be charged to Account No. 125-378-5504-7214 (Pavement Rehabilitation 6th Street) . RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO ALL AMERICAN ASPHALT CORPORATION FOR PAVEMENT REHABILITATION ON 6TH STREET FROM "E" STREET TO ARROWHEAD AVENUE PER PLAN NO. 10260. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. All American Asphalt Corporation is the lowest responsible bidder for 7 8 9 awarded accordingly to said bidder in a total amount of $97,182.85, with a contingency 10 pavement rehabilitation on 6th Street from "E" Street to Arrowhead Avenue. A contract is 11 amount of $14,774.43, but such award shall be effective only upon being fully executed by 12 both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized 13 14 15 16 and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. 17 SECTION 2. This contract and any amendment or modifications thereto shall not take 18 effect or become operative until fully signed and executed ,by the parties and no party shall be 19 obligated hereunder until the time of such full execution. No oral agreements, amendments, 20 modifications or waivers are intended or authorized and shall not be implied from any act or 21 course of conduct of any party. 22 23 SECTION 3.
